ORDINANCE NO. <br />AN ORDINANCE AUTHORIZING THE MAYOR TO <br />TEMPORARILY CHANGE THE HOURS AND DATES FOR <br />ANY CITY ENTERTAINMENT DISTRICT FOR THE CITY OF <br />BATESVILLE, ARKANSAS; AND FOR OTHER PRUPOSES <br />WHEREAS, the State of Arkansas passed into law Act 812 of 2019, hereinafter referred to as "Act <br />812," to promote hospitality and tourism; to establish areas of a city or town that highlight restaurant, <br />entertainment, and hospitality options; to establish temporary or permanent designated entertainment <br />districts; and for other purposes., and <br />WHEREAS, the City of Batesville currently has established an enterainment district <br />downtown and a temporary entertainment district at riverside park, which may be declared by <br />mayoral proclomation, and <br />WHEREAS, that the current ordinance limits the downtown entertainment district to certain <br />times and dates, and <br />WHEREAS, that there are special events, such as the upcoming eclipse, in which the City <br />wishes to promote business, tourism, and the general enjoyment of said events; and <br />WHEREAS, that authorizing the Mayor to temporarily change the hours or times of operation <br />of the entertainment districts will allow the City the flexibility to promote these goals. <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF BATESVMLE, ARKANSAS, AS FOLLOWS: <br />Section 1. That the Mayor is hereby authorized to temporarily change the times and <br />hours of operation of any Entertainment District within the city of Batesville, Arkansas. That <br />said temporary changes shall specify the dates and times for said changes through Mayoral <br />proclamation. <br />Section 2. That all ordinances and parts thereof in conflict herewith are hereby repealed <br />to the extent of such conflict. <br />Section 3. If any portion or portions of this ordinance are deemed or held to be invalid, <br />such invalidity shall not affect the remaining portions of this ordinance. <br />Section 4. That the need for passage of this ordinance is immediate. Therefore, it is <br />hereby declared that an emergency exists and this Ordinance being necessary for the <br />immediate preservation of public peace, health, safety and welfare shall be in force and take <br />effect immediately upon its passage. <br />PASSED AND APPROVED THIS DAY OF MARCH, 2023. <br />Rick Elumbaugh, Mayor <br />ATTEST: <br />Denise Johnston, City Clerk <br />
