ORDINANCE NO. 2007-8-2 <br /> AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE THE <br /> PURCHASE OF A UTILITY BILLING PROGRAM FOR THE BATESVILLE UTILITY <br /> DEPARTMENT <br /> WHEREAS, the Batesville Utility Department's current utility billing program <br /> has reached its capacity; and <br /> WHEREAS, the City is currently using INCODE as its accounting program <br /> and INCODE's utility billing program will integrate with the City's accounting <br /> program; and <br /> WHEREAS, comparing software programs is difficult and the City is currently <br /> a customer of INCODE and knows the reliability of their software programs. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF <br /> BATESVILLE, ARKANSAS: <br /> Section 1. That the Batesville Utility Department needs to purchase a Utility <br /> Billing program. <br /> Section 2. That said program is to be purchased from the INCODE for the <br /> approximate sum of $55,000.00, more or less. <br /> Section 3. That the City Council in accordance with the terms of A.C.A. <br /> Section 14-58-303 hereby waives the requirement of competitive bidding and directs <br /> the Purchasing Officer to purchase the above described utility billing program for the <br /> price set forth in Section 2 above. <br /> Section 4. EMERGENCY CLAUSE: It is further found that due to the <br /> immediate need to acquire the above utility program, an emergency is declared to <br /> exist and this ordinance being necessary for the preservation of the public peace, <br /> health and safety shall take effect from and after its passage and approval. <br /> PASSED AND APPROVED this 28th day of August, 2007. <br /> Aj?. a <br /> Honorable R' mbaugh, Mayor <br /> ATTEST: <br /> Q� 1 <br /> Denise M.
