He said although <br />Memphis Pools denies any liability, they have agreed to settle with the City. <br />In the settlement, Memphis Pools agrees to repair cracks to the monolithic <br />shotcrete shell of the pool and replaster. The total repairs will be in excess of <br />two hundred thousand dollars. The City has agreed to pay ½ of the cost of <br />the replaster which is $81,322.00 and will be paid out of the Community <br />Center Perpetual Maintenance Fund. Councilmember Matthews moved to <br />adopt the resolution. Councilmember Bryant seconded and the roll call count <br />was 8 for and 0 against. The resolution was given #2022-08-04-R. <br />B) CONSIDER A RESOLUTION APPROVING AN AGREEMENT <br />RESPECTING WATERLINES WITHIN AREA 4 OF SYSTEM <br />IMPROVEMENTS 2018-2019 <br />Councilmember Matthews introduced a resolution to approve an <br />agreement respecting waterlines within the Pfeiffer Public Water Authority. <br />Mayor Elumbaugh said Batesville Water currently does the billing and <br />repairs that are reimbursed to Batesville for the Pfeiffer Public Water <br />Authority. He said because their system is adjacent to Batesville on the <br />north and east sides of Batesville, we are interested on their <br />improvements. Their board approved the improvements for 6” water lines, <br />however, our Engineers recommend 12” for growth to that area. The <br />approval of the resolution will allow the appropriation of $280,025.00 paid <br />for out of the Water Utility Additions and Improvements Funds to fund the <br />cost to install 12” water lines instead of 6” lines.
