. 10. To prevent the pollution of air, streams, and ponds; to assure the adequacy of drainage <br /> facilities; to safeguard the water table, and to encourage the wise use and management of <br /> natural resources throughout the city in order to preserve the integrity, stability, and beauty of <br /> the community and the value of the land. <br /> 11. To preserve the natural beauty and topography of the city and to ensure appropriate <br /> development with regard to these natural features. <br /> 12. To provide for open spaces through the most efficient design and layout of the land, including <br /> the use of average density in providing for minimum width and area of lots, while preserving <br /> the density of development as established in the zoning ordinance of the city. <br /> 13. To remedy the problems associated with inappropriately subdivided lands, including premature <br /> subdivision, excess subdivision, partial or incomplete subdivision, scattered and low-grade <br /> subdivision. <br /> Section 15.01.04 Authority <br /> The Planning Commission of the City of Batesville (hereinafter "Planning Commission') is vested with <br /> the authority to review, approve, conditionally approve and disapprove applications for the subdivision of <br /> land, including sketch, preliminary, and final plats. The Planning Commission may grant variances from <br /> these regulations pursuant to the provisions of Section 1.12. <br /> Section 15.01.05 Jurisdiction <br /> • 1. These regulations apply to all subdivision of land, as defined in Section 2. (Definitions),located <br /> within the corporate limits of the city or outside the corporate limits as provided by law. <br /> 2. No land shall be subdivided through the use of any legal description other than with reference <br /> to a plat approved by the Planning Commission in accordance with these regulations. <br /> These regulations shall apply to any subdivision that was platted prior to the effective date of <br /> these regulations whenever the original subdivider or his successor failed to complete <br /> subdivision improvement requirements pursuant to a subdivision improvement agreement <br /> entered into when the plat for the subdivided land was approved and the plat contains <br /> contiguous lots in common ownership where one or more of the contiguous lots is <br /> undeveloped, whether the lots are owned by the original subdivider or an immediate or remote <br /> grantee from the original subdivider; except that this section shall not apply if the city has <br /> obtained possession of sufficient funds from security provided by the subdivider with which to <br /> complete construction of improvements in the subdivision. <br /> Whenever the jurisdiction of the Planning Commission is exercised in such situations only the <br /> sale, lease, transfer, or development of an undeveloped lot or lots contiguous to a lot or lots in <br /> common ownership shall be subject to these regulations. <br /> 4. No land described in this Section 1.5 shall be subdivided or sold, leased, transferred or <br /> developed until each of the following conditions has occurred in accordance with these <br /> regulations: <br /> • a. The subdivider or his agent has submitted a conforming sketch plat of the subdivision to <br /> the person designated by the Planning Commission; and <br /> -141 - Batesville Subdivision Regulations <br />
