<br /> AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS MAP; AND FOR
<br /> OTHER PURPOSES.
<br /> WHEREAS,Rich Realty,with the agreement of Merchants&Planters Bank requested that
<br /> the below described property be re-zoned from Single-Family Residential(R-2)to Commercial
<br /> Community(C-1)in order to the actual uses of said property;and,
<br /> WHEREAS,the Batesville Planning Commission has reviewed the relationship of this
<br /> property with the Comprehensive Plan and determined that the requested re-zoning was entirely
<br /> consistent with said Plan;and,
<br /> WHEREAS,the Batesville Planning Commission conducted a properly advertised public
<br /> hearing at a regularly scheduled meeting on March 3,2025 to consider said proposed amendment to
<br /> the Zoning Districts Map; and,
<br /> WHEREAS,the Batesville Planning Commission voted at its regularly scheduled meeting on
<br /> March 3,2025 to approve the requested amendment to the Zoning Districts Map as being in the best
<br /> interest of the future development of the City of Batesville,and further recommends that the
<br /> Batesville City Council adopt said amendment to the Zoning Districts Map.
<br /> NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
<br /> BATESVILLE,ARKANSAS THAT THE BATESVILLE ZONING DISTRICTS MAP IS
<br /> HEREBY AMENDED AS FOLLOWS:
<br /> Section 1: For the following described property,from Single-Family Residential(R-1)to
<br /> Commercial Community District(C-1)zoning classification,as displayed on Exhibit A
<br /> attached hereto:
<br /> Part of the Southeast Quarter of the Southeast Quarter(SE '/4 SE '/4)of Section 15,
<br /> Township 13 North,Range 6 West, in the City of Batesville,Independence County,
<br /> Arkansas,being more particularly described as follows: Commencing at a locally
<br /> accepted corner per PLS#929 for the Northwest corner of said Southeast Quarter of the
<br /> Southeast Quarter(SE'/4 SE '/4)of Section 15,then run S87°36'55"E,21.43 feet to an
<br /> iron pin on the East R/W Line of 301 Street, said point being the true point of beginning,
<br /> then continue S87°3615511E, 119.73 feet to an iron pin,then run S03°12'12"W,293.92
<br /> feet to an existing iron pin on the R/W line of Arkansas Highway#69 stamped PLS
<br /> #1120,then run along said highway R/W line as follows:N79°52'31"W, 12.91 feet to
<br /> PLS#1120 iron pin,then run S 10°07'29"W, 17.68 feet to PLS#1120 iron pin,then run
<br /> N80020'52", 86.00 feet to PLS#1120 iron pin,then run N38°57'10"W,28.07 feet to PLS
<br /> #1120 iron pin being on the east R/W line of 30`s Street,then run NO2°57'27"E along the
<br /> east R/W line of 30' Street a distance of 277.83 feet back to the point of beginning,
<br /> containing 0.82 acre,more or less,and being subject to all recorded rights-of-way and
<br /> easements.
