ORDINANCE NO. 2025-07-03 <br /> AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS MAP; AND <br /> FOR OTHER PURPOSES. <br /> WHEREAS,Azemi Holdings LLC requested that the below described property,and as shown at <br /> Exhibit A,be re-zoned from Commercial Community(C-1)to General Family Residential(R-2)in order <br /> to develop said property into much needed multi-family residential use; and, <br /> WHEREAS,the Batesville Planning Commission has reviewed the relationship of this property <br /> with the Comprehensive Plan and determined in a prior action to amend the Plan in support of such use <br /> and that the requested re-zoning would be consistent with said Plan;and, <br /> WHEREAS,the Batesville Planning Commission conducted a properly advertised public hearing <br /> at a regularly scheduled meeting on July 7,2025 to consider said proposed amendment to the Zoning <br /> Districts Map; and, <br /> WHEREAS,the Batesville Planning Commission,finding such use to be an appropriate use <br /> buffer between intense commercial use to the north,east and west of said property and single family <br /> residential use to the south of the property,voted at its regularly scheduled meeting on July 7,2025 to <br /> approve the requested amendment to the Zoning Districts Map as being in the best interest of the future <br /> development of the City of Batesville by expanding housing choices,and further recommends that the <br /> Batesville City Council adopt said amendment to the Zoning Districts Map. <br /> NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> BATESVILLE,ARKANSAS THAT THE BATESVILLE ZONING DISTRICTS MAP IS <br /> HEREBY AMENDED AS FOLLOWS: <br /> Section 1: For the following described property,from Commercial Community District(C-1)to General <br /> Family Residential(R-2)zoning classification, as displayed on Exhibit A attached hereto: <br /> A 1.53 acre tract of land being part of the Southeast Quarter of the Southeast Quarter(SE'/4 <br /> SE '/4)of Section 15, Township 13 North,Range 6 West, in the City of Batesville, <br /> Independence County,Arkansas,being more particularly described as follows: Commencing <br /> at the southeast corner of said Section 15;then run along the south line of said SE '/4 SE '/4, <br /> N88°54'09"W,a distance of 675.74 feet to a calculated point;thence leaving said south line, <br /> NO1°45'52"E,a distance of 304.95 feet to a found ''/z"rebar,representing the point of <br /> beginning: thence run N88°54'26"W,a distance of 311.49 feet to a found'h" rebar;thence, <br /> NO2°36'43"E,a distance of 217.40 feet to a set'/z" rebar;thence S88°14'05"E,a distance of <br /> 308.25 feet to a set%" rebar;thence SO 145'49",a distance of 213.72 feet back to the point <br /> of beginning of said 1.53 acre tract. <br /> The foregoing also described as Assessor parcel ID numbers 1 1003730001 <br /> Road Easement Description <br /> A tract of land being a part of the Southeast Quarter of the Southeast Quarter(SE'/4 SE '/4)of <br /> Section 15,Township 13 North,Range 6 West, in the City of Batesville,Independence <br /> County,Arkansas,being more particularly described as follows: Commencing at the <br /> southeast corner of said Section 15;thence run along the south line of said SE '/4 SE '/4, <br /> N88°12'01"W,a distance of 675.74 feet;thence NO2°28'00"E,a distance of 304.95 feet; <br /> thence N88°12'18"W,a distance of 273.52 feet to the point of beginning;thence <br /> N88°12'18"W,a distance of 25.02 feet;thence N04°03'40"E,a distance of 636.51 feet to the <br /> nominal south right-of-way line of Harrison Street;thence S79°25'43"E along said right-of- <br />
