ORDINANCE NO.2013-02-01 <br /> © AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS MAP; AND FOR <br /> OTHER PURPOSES. <br /> WHEREAS,the owners of the residential structure at 1211 E. Boswell Street,which has most <br /> recently been utilized as a realty office, desire to again utilize the structure for its original residential <br /> purposes;and, <br /> WHEREAS,the current zoning classification of said property is Commercial Community(C-1), <br /> which does not permit residential use; and <br /> WHEREAS,the owners wish to occupy the structure and obtain designation of said structure as <br /> an historical property on the National Register of Historic Properties;and <br /> WHEREAS,the Batesville Planning Commission,after a properly advertised public hearing on <br /> February 4,2013,determined that the utilization of this property for residential purposes is consistent <br /> with the intent of historic residential land use district immediately across the street from said property, <br /> and voted to amend the Comprehensive Plan to further that objective; and, <br /> WHEREAS,the Batesville Planning Commission,after a separate properly advertised public <br /> hearing on February 4,2013, voted to recommend that the zoning classification of the subject property be <br /> changed from Community Commercial(C-1)to Historic Residential(HR),as furthering the objectives of <br /> the Comprehensive Plan and being in the best interests of the City of Batesville. <br /> NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> O BATESVILLE,ARKANSAS THAT THE BATESVILLE ZONING DISTRICTS MAP IS <br /> HEREBY AMENDED AS FOLLOWS: <br /> From Community Commercial(C-1)to Historic Residential(HR): Lot 10, Block 56 of the School <br /> Addition <br /> IF ANY PORTION OR PORTIONS OF THIS ORDINANCE ARE DEEMED OR HELD <br /> TO BE INVALID,SUCH INVALIDITY SHALL NOT EFFECT THE REMAINING PORTION <br /> OR PORTIONS OF THIS ORDINANCE. <br /> IT IS SO ORDAINED. <br /> IN WITNESS WHEREOF,we have set our hands this 12`h day of February, 2013. <br /> J <br /> APPROVED: <br /> RICK EL <br /> ATTEST: U�.t.J /" I C}8'��— <br /> DENISE JOHNSTON,CL <br /> IA R VEA R VESTOLEGALFORM: <br /> k Ali <br /> • Lindsey stAIJrry,City Attorney <br />
