• Section 18. The City agrees that the Bondholder may pledge the bonds as <br /> security for the ADFA Bonds, and that the ADFA Trustee and/or the municipal bond insurer for <br /> the ADFA Bonds may exercise any rights and remedies available to the Bondholder under this <br /> Ordinance or the Agreement while the bonds are pledged and/or insured. In addition, the City <br /> agrees that while the bonds are pledged and/or insured, copies of all financial information shall, <br /> upon written request, be furnished to the ADFA Trustee and/or the municipal bond insurer. <br /> Section 19. The City is responsible for complying with the specific <br /> requirements of the American Recovery and Reinvestment Act of 2009 ("ARRA"). Specific <br /> ARRA requirements include but are not limited to: <br /> ARRA Section 1512 Reporting Requirements; <br /> ARRA Section 1553 Whistleblower Protections; <br /> ARRA Section 1605 Buy American Requirements; <br /> ARRA Section 1606 Wage Rate Requirements; and <br /> ARRA Sections 902, 1514 and 1515 General Accountability Office and Inspector <br /> General Access and Review Requirements. <br /> • Section 20. The provisions of this Ordinance are hereby declared to be severable, <br /> and if any provision shall for any reason be held illegal or invalid, it shall not affect the validity <br /> of the remainder of this Ordinance. <br /> Section 21. Reference in this Ordinance to "Bondholder" shall include the <br /> original Bondholder or any registered assign thereof. <br /> Section 22. All ordinances and resolutions and parts thereof in conflict herewith <br /> are hereby repealed to the extent of such conflict. <br /> • <br /> 10 <br />
