<br /> AN ORDINANCE ACCEPTING THE DEDICATION OF A CITY
<br /> STREET KNOWN AS VALLEY VIEW ROAD TO THE CITY OF
<br /> BATESVILLE, ARKANSAS
<br /> WHEREAS, Al Crouch (Mountain Ridge Development, LLC) has executed and
<br /> delivered to the City of Batesville, Arkansas, its Deed of Dedication for the purpose of a
<br /> city street, known as Valley View Road, an easement across the following described
<br /> property; subdivision known as The Village at Eagle Mountain located within the city of
<br /> Batesville:
<br /> PROPERTY DESCRIPTION
<br /> A tract of land being a part of the Southwest 1/4, Section 24 and a part of the Northwest 1/4,
<br /> Section 25, T 13 N, R 6 W, in the City of Batesville, Independence County, Arkansas, more particularly described as follows:
<br /> Commencing at the Northwest corner of said Section 25,
<br /> thence S 87'50'23" E, along the north line of said Section 25, 910.40 feet;
<br /> thence S 02'09'37" W, 28.37 feet to the north right of way line of Mountain Ridge Road and the point of beginning;
<br /> thence N 30'48'31" E, 139.67 feet;
<br /> thence N 59'56'40" E, 105.34 feet;
<br /> thence N 71'56'36" E, 102.45 feet;
<br /> thence N 85'50'36" E. 102.18 feet;
<br /> thence S 66'20'51" E, 72.04 feet;
<br /> thence S 82'16'57" E, 60.81 feet;
<br /> thence S 89'49'05" E, 264.06 feet;
<br /> thence S 09'38'30" E, 112.97 feet;
<br /> +hence S 43'01'54" E, 89.75 feet to the northwest corner of Lot 27,

<br /> north right of wayline of said Mountain Ridge Road;

<br /> along a curve to the right, said curve having a radius of 327.02 feet, an arc length of 92.28
<br /> feet, a long chord bearing and distance of N 53'4420' W, 91.97 feet
<br /> N 45'39'18 W, 268.88 feet;
<br /> along a curve to the left, said curve having a radius of 274.99 feet, an arc length of 160.28 feet,
<br /> a long chord bearing and distance of N 62'2110 W, 155.02 feet;
<br /> N 79'03'16"W, 81.28 feet to the point of beginning.
<br /> This tract contains 6.47 acres, more or less, and is subject to any and all easements.
<br /> WHEREAS, the said Valley View Road has been constructed in accordance with the
<br /> requirements of the City of Batesville; and has received a final plat approval from the
<br /> Batesville Planning Commission on 12-14-09; and the public benefit will be served by
<br /> the acceptance and maintenance of Valley View Road.
<br /> BE IT THEREFORE ORDAINED BY THE CITY COUNCIL OF BATESVILLE,
<br /> ARKANSAS:
<br /> That the City of Batesville hereby accepts for purposes of maintenance,the public
<br /> street known as Valley View Road.
<br /> This ordinance adopted this 22nd day of December 2009.
