© ORDINANCENO. <br /> AN ORDINANCE REZONING 25.14 ACRES OF ANNEXED PROPERTY OWNED <br /> BY THE UNIVERSITY OF ARKANSAS COMMUNITY COLLEGE AT <br /> BATESVILLE FROM R-1 TO R-2 RESIDENTIAL;DECLARING AN EMERGENCY <br /> AND OTHER PURPOSES. <br /> BE 1T ORDAINED BY THE CITY OF BATESVILLE AS FOLLOWS: <br /> (1) The following property be and the same is hereby rezoned from R-1 Residential to R- <br /> 2 Residential. In accordance with municipal ordinance 9999, section IV, subsection 4, <br /> all annexed property within the corporate limits of the City of Batesville is required to <br /> have a public hearing conducted by the city planning commission for the <br /> determination of the most appropriate zoning for the annexed property. The Batesville <br /> Planning Commission conducted a public hearing on January 07, 2002 and has <br /> recommended that the zoning remain consistent with the original campus. <br /> (2) The property is described as thus: <br /> A tract of land being a part of Section 2 and a part of Section 3 all in T 13 N,R 6 W <br /> in Independence County,Arkansas,more particularly described as follows:beginning <br /> at a point on the north right of way line of White Drive said point being 49.92 feet <br /> north and 20.02 feet west of the southeast corner of said Section 3;thence N 89* 56' <br /> 01" W along said north right of way line, 852.13 feet to the centerline of Pfeiffer <br /> Creek; thence along said centerline the following: N 06° 12' 03" W 226.00 feet;N <br /> 19° 52'46" E 136.22 feet;N 32° 18'43" E 125.14 feet;N 190 12'04"E 426.55 feet; <br /> N 190 15' 42" W 201.25 feet; N 19° 13' 05" E 193.33 feet; thence N 88° 57' 32" E <br /> 882.99 feet to the extension of a wire fence; thence S 02° 31' 15" W along said <br /> extension and along said fence, 731.90 feet; thence S 89° 41' 48" W 210.39 feet; <br /> thence S 01' 35' 55" W 518.83 feet to the point of beginning. Containing 25.14 <br /> acres, more or less, subject to any and all easements. <br /> (3) It is hereby found and declared that an emergency exists and that this ordinance being <br /> necessary for the public welfare, it shall be in full force and effect from the date of its <br /> passage. <br />
