• ORDINANCE No. cgCOA-g-I AN ORDINANCE REZONING 3 . 06 ACRES OF PROPERTY OWNED BY MDM CORPORATION AND/OR LEONARD WIGGINS AT BATESVILLE FROM R-2 TO R-1; DECLARING AN EMERGENCY AND OTHER PURPOSES . BE IT ORDAINED BY THE CITY OF BATESVILLE AS FOLLOWS : (1) In accordance with a recommendation of the Batesville Planning Commission made on April 1, 2002, the property described hereinbelow be, and the same is hereby, rezoned from R-2 to R- 1 Residential . Said recommendation followed an application filed by multiple owners of property located in the Eagle Mountain Development to the City of Batesville with the Batesville Planning Commission and which requested that a public hearing be conducted by said Planning Commission. Further, said recommendation followed notice to the property owner, Leonard Wiggins and/or MDM Corporation, of the application and of the public hearing which was held on April 1, 2002 . (2) The property is described thus : A tract of land being a part of the NW 1/4 , SE 1/4 , Section • 23 , T 13 N, R 6 W, in Independence County, Arkansas, more particularly described, as follows : Commencing at the southeast corner of said NW 1/4 , SE 1/4 ; thence N O1 deg. 02143" E along the east line of said NW 1/4 , SE 1/4 , 800 . 65 feet to the point of beginning; thence N 88 deg. 57' 15" W, 294 . 53 feet to the east right of way line of Eagle Mountain Boulevard; thence along said right of way line, along a curve to the left, said curve having a radius of 617 . 94 feet, an arc length of 297 .39 feet, a long chord bearing of N 42 deg. 07' 54" W and a long chord distance of 294 . 53 feet; thence continuing along said right of way line, N 55 deg. 55' 10" W, 8 . 58 feet; thence N 63 deg. 53 ' 50" E, 332 .42 feet; thence S 77 deg. 44113" E, to the east line of said NW 1/4 , SE 1/4 ; thence S O1 deg 02' 43" W, 330 . 0 feet to the point of beginning.
