t <br /> ORDINANCE NO,-�10/34Q-/ <br /> AN ORDINANCE TO PROVIDE ACCESS TO HEALTH BENEFITS <br /> FOR RETIRED MUNICIPAL EMPLOYEES AND FOR OTHER PURPOSES. <br /> WHEREAS, Act 644 of 1995 (Ark. Code Ann. §24-12-129) permits any municipal <br /> official or municipal employee age fifty-five (55) or over who has completed twenty (20) <br /> years of service to the municipality and who is receiving a retirement benefit from the <br /> Arkansas Local Police and Fire Retirement System, Arkansas Public Employees <br /> Retirement System, or a Local pension fund to continue to participate in the <br /> municipality's health care plan; and <br /> WHEREAS, The Arkansas State Legislature passed and enacted Act 1279 of 2009 (Ark. <br /> Code Ann. §24-12-132), which requires municipalities to establish the criteria for <br /> eligibility as a retiree; <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF <br /> BATESVILLE, ARKANSAS, THAT; <br /> SECTION 1: A retired employee or official age fifty-five (55) or over who has <br /> completed twenty (20) years of service to the city and his or her family is eligible for <br /> retiree coverage under the city's health plan if they are otherwise qualified under Act <br /> 1279 of 2009. <br /> SECTION 2: Pursuant to Act 1279 (Ark. Code Ann. §24-12-132), the city council <br /> hereby declares that a retired employee or official age fifty-five (55) or over who has <br /> completed twenty (20) years of service to the municipality or a retired employee or <br /> official of any age who has completed twenty-seven (27) years of service to the <br /> municipality,may participate in the municipal health care plan if he or she: <br /> 1. Is eligible to receive retirement benefits from the Arkansas Local Police <br /> and Fire Retirement System, Arkansas Public Employees Retirement <br /> System. or a local pension fund; <br /> 2. Pays both the employer and the employee contribution to the health care <br /> Plan; <br /> 3. Is not covered at any time during retirement by another health care plan; <br /> and <br /> 4. Notifies the city within thirty (30) days after the official date of retirement <br /> of his or her intent to participate in the city's health care plan. <br /> SECTION 3: Passage of this Ordinance is necessary to assure the orderly and <br /> productive administrative of the City's policies concerning all its employees. It is <br /> essential that City employees receive prompt notification concerning the benefits <br /> available to them upon retirement, and such notice should be made at the earliest possible <br /> moment.
