cil -V ci, <br /> ORDINANCE NO. -1ooS-` j– <br /> AN ORDINANCE AMENDING ORDINANCE NO. 2005-6-1, SECTION 4, <br /> SUBSECTION (A), DECLARING AN EMERGENCY AND FOR OTHER <br /> PURPOSES. <br /> WHEREAS, in order to have a wide range of selections to choose from related to <br /> tourism, it is necessary and expedient to enact this ordinance. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF <br /> BATESVILLE, ARKANSAS: <br /> SECTION 1. Ordinance No. 2005-6-1, Section 4, Subsection (a) is hereby <br /> amended as follows: <br /> (a) Four (4) members of whom shall be owners or managers of <br /> businesses in the tourism industry, at least three (3) of whom shall <br /> be owners or managers of hotels, motels, or restaurants, and all of <br /> whom shall be appointed by the governing body of the City for <br /> staggered terms of four (4) years, as provided by Ark. Code Ann. <br /> 26-75-605(b). A member or members may live outside the City <br /> limits of Batesville, Arkansas, but within Independence <br /> County, at the discretion of the Batesville City Council, <br /> however theV must be owners or managers of referenced <br /> businesses which are located within the City limits of the City <br /> of Batesville. <br /> SECTION 2. EMERGENCY CLAUSE. Due to giving the appropriate time to set <br /> certain things in motion, an emergency is hereby declared to exist and in the <br /> interest of the public health, welfare and peace, this ordinance shall be in full <br /> force and effect from and after its passage. <br /> ADOPTED the S day of \ 2005. <br /> ATTEST: PJT—M.
