ORDINANCE# 4g00S /�J <br /> AN ORDINANCE TO AMEND ORDINANCE NUMBER 986 OF 1982 TO ALLOW <br /> THE USE OF "DRIVE OVER TYPE CURBS" IN CERTAIN RESIDENTIAL <br /> SUBDIVISION APPLICATIONS. <br /> WHEREAS, Ordinance Number 986 of 1982, allows for only one type of <br /> curb to be used on all city streets whether they are major streets or minor streets, <br /> and <br /> WHEREAS, residential sub-division developers are under undue burden <br /> because the current curb requirements, and <br /> WHEREAS, the use of a "drive over" type curb will enhance the aesthetics <br /> of residential sub-divisions by removing the need for driveway curb cuts each <br /> time a home is constructed, and <br /> WHEREAS, it is determined that the city's best interest will be served by <br /> encouraging new residential sub-divisions. <br /> NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF <br /> BATESVILLE, ARKANSAS THAT ORDINANCE 986 OF 1982 IS HEREBY <br /> AMENDED AS FOLLOWS: <br /> Section 1 (B.) currently reads: <br /> Directly adjacent to and connecting with each side of the traveled portion <br /> of the street, there shall be a curb. The curb shall be constructed as follows: <br /> each curb shall consist of a 6 inch concrete base. Each curb shall be 24 inches <br /> in width. 18 inches of said curb width shall be consistent with the height of the <br /> street and drop from the crown in the middle of the street to the edge of the street <br /> side to allow for water drain off. The remaining 6 inches of said curb width shall <br /> form a lip 6 inches in height greater than the above described curb surface and <br /> 12 inches in height from said base. <br /> Section 1 (B.) is hereby amended to read as follows.- <br /> (a.) <br /> ollows:(a.)
