RESOLUTION NO. <br /> A RESOLUTION PROVIDING A MORATORIUM OF UP TO 90 DAYS ON <br /> PERMITTING MANUFACTURED HOUSING IN BATESVILLE, ARKANSAS, <br /> IN REGARD TO ACT 624 OF THE ARKANSAS GENERAL ASSEMBLY. <br /> WHEREAS, the Arkansas General Assembly has passed Act 624 of 2003 which <br /> requires Arkansas cities that enforce zoning regulations to permit manufactured <br /> housing in at least one residential zoning area; and <br /> WHEREAS, the City of Batesville intends to comply with Act 624 and considers <br /> this to be an element of importance within the Batesville Zoning Code and is an <br /> issue worthy of careful consideration; and <br /> WHEREAS,the Batesville City Council met in Special Session with members of <br /> the Batesville Planning Commission on September 18, 2003 to discuss and exchange <br /> ideas on a draft ordinance to comply with Act 624; and <br /> WHEREAS,Act 624 is to take effect October 1, 2003, the Batesville City Council <br /> believes it is in the best interest of its citizens and Act 624 to proceed in a timely <br /> but cautious manner and wishes not to rush into the deadline without having full <br /> confidence in the document. However, the Batesville City Council does recognize the <br /> importance of proceeding as expeditiously as possible. <br /> NOW THEREFORE, BE IT RESOLVED BY THE BATESVILLE CITY <br /> COUNCIL: <br /> Section 1. A 90-day moratorium is provided for the permitting of a manufactured home <br /> within Batesville, Arkansas, and the intent is to have an ordinance before the 90-day <br /> moratorium expires and is not designed to delay the implementation of Act 624. <br /> Section 2. The 90-day moratorium is effective from the date of the passage of this <br /> Resolution. <br /> PASSED this 23RD day of September 2003. <br /> APPROVED: <br /> oe M.
