i <br /> WARRANTY DEED <br /> • KNOW ALL MEN BY THESE PRESENTS. <br /> THAT the City of Batesville, Arkansas, by and through its Mayor, Joe <br /> Baird, and its City Clerk, Denise Johnston, duly elected and serving, pursuant to <br /> Batesville City Ordinance No. 99-12-2, and duly authorized by the Batesville <br /> City Council as requested by the Batesville Utility Commission in its September <br /> 23, 2003, resolution and in consideration of the sum of One Dollar (S 1.00) and <br /> other valuable consideration to the City of Batesville in hand paid by said <br /> grantees, the receipt and sufficiency of which is hereby acknowledged, hereby <br /> grants, bargains, sells and conveys, subject to reservation of a sewer easement to <br /> Bank of America as successor in interest to First National Bank of Batesville, its <br /> successors and assigns forever, the following lands lying in Independence <br /> County, Arkansas to wit: <br /> I <br /> A tract of land being a part of the Southwest Quarter of <br /> Section 13, Township 13 North, Range 6 West, a part of <br /> Wolford's Quail Valley East Subdivision all in the City <br /> of Batesville, Independence County, Arkansas, more <br /> particularly described as follows: Commencing at the <br /> Southeast corner of said SW'/4; thence N 00° 49' 52" <br /> East along the East line of said SWI/4 a distance of <br /> 2416.56 feet to the north right of way line of Turkey i <br /> Run and the point of beginning; thence Southwesterly <br /> along said north right of way line and along a curve to i <br /> the left, said curve having a radius of 120.95 feet, a <br /> distance of 116.21 feet; thence S 35° 46' 58" W a <br /> distance of 36.20 feet; thence N 09° 07' 52" E a <br /> distance of 132.05 feet to the south right of way line of <br /> Harrison Street; thence Northeasterly along said right of i <br /> way line and along a curve to the right, said curve <br /> having a radius of 1858.83 feet, a distance of 106.94 <br />
