RESOLUTION #2009-04-01-R <br /> WHEREAS, the City of Batesville, Arkansas owns and operates a Wastewater <br /> Treatment and Collection System serving the residential, commercial and industrial needs <br /> of the citizens of Batesville, Arkansas; and <br /> WHEREAS, the present facilities are inadequate and overloaded; and <br /> WHEREAS, because of hydraulic overloading of the Wastewater Treatment Plant <br /> and raw sewage overflows occurring within the City, the Arkansas Department of <br /> Environmental Quality (ADEQ) issued a Consent Administrative Order(CAO) in July <br /> 2008 against the City; and <br /> WHEREAS, in response to said CAO the City hired the engineering firm of <br /> McGoodwin, Williams & Yates, Inc. of Fayetteville, Arkansas to determine the best course <br /> of action to enable the City to comply with the terms, conditions and requirements of the <br /> CAO; and <br /> WHEREAS, McGoodwin, Williams & Yates, Inc. prepared a proposal of <br /> improvements to the City's Wastewater Treatment and Collection System (the "Project") <br /> to bring the City into compliance with the CAO; and <br /> WHEREAS, the City obtained a loan commitment (the "Loan") for funding of the <br /> "Project" from the State of Arkansas Revolving Loan Fund administered by the Arkansas <br /> Natural Resources Commission(ANRC); and <br /> WHEREAS, the City presented to the Citizens of Batesville on March 10, 2009, a <br /> ballot proposal for a one percent sales and use tax to repay the "Loan"; and <br /> WHEREAS, on March 10, 2009 the Citizens of Batesville voted by a margin of <br /> approximately ninety three percent (93%) in favor of the one percent sales and use tax to <br /> repay the "Loan"that will fund the "Project"; and <br /> WHEREAS, the City desires to hire the engineering firm of McGoodwin, <br /> Williams & Yates, Inc. to do the necessary engineering work for the "Project"; and <br /> WHEREAS, approval of the Agreement For Engineering Services between the <br /> City of Batesville and McGoodwin, Williams & Yates, Inc. by ANRC is required and has <br /> been obtained by the City. <br />
