i <br /> RESOLUTION NO. 97-6-1 <br /> RESOLUTION TO AUTHORIZE THE CITY COUNCIL <br /> • AND THE MAYOR OF THE CITY OF BATESVILLE TO <br /> ENTER INTO NEGOTIATIONS WITH INDEPENDENCE <br /> COUNTY FOR AN INTERLOCAL AGREEMENT TO <br /> FORM A LOCAL ELECTRIC UTILITY, AND FOR OTHER <br /> PURPOSES <br /> WHEREAS, the Batesville and Independence County Task Force for Lower <br /> Electric Rates (the "Task Force") has diligently studied and pursued options for lower <br /> electric rates for citizens of Batesville, and Independence County, and <br /> WHEREAS, the Task Force has unanimously recommended that Batesville and <br /> Independence County enter into negotiations for an interlocal agreement to form a local <br /> electric utility and to concurrently conduct a feasibility study for the acquisition of the <br /> Entergy electric distribution system in Independence County; and <br /> WHEREAS, it is the desire of Batesville to pursue with Independence County <br /> lower electric rates for its citizens, while at the same time provide reliable electric <br /> service to its citizens. <br /> NOW, THEREFOR, BE IT RESOLVED by the City Council of Batesville, <br /> Arkansas that: <br /> • Section 1. The City Council of Batesville, Arkansas, hereby authorizes the City Council <br /> and the Mayor to enter into negotiations with Independence County for an interlocal <br /> agreement to form a local electric utility. <br /> Section 2. The interlocal agreement shall establish, define, and set out the composition, <br /> functions, and powers, responsibilities, and duties of a local electric utility. <br /> Section 3. Negotiations for said interlocal agreement shall be conducted concurrently <br /> with an economic feasibility study to be undertaken by the County. <br /> Section 4. It is the understanding and intention of the Batesville City Council that an <br /> interlocal agreement to establish a local electric utility shall only be effective after <br /> consideration and approval by respective ordinances of the City Council and the <br /> Independence County Quorum Court. <br /> Section 5. It is further understood by the Batesville City Council that nothing contained <br /> herein shall obligate the City of county to establish a local electric utility and that <br /> acquisition of Entergy's electric distribution system in Batesville and Independence <br /> County can only be accomplished if it is economically feasible and after referendum by <br /> the citizens of the City and County and approval by the Arkansas Public Service <br /> Commission. <br /> ® Section 6.
