Mayor Elumbaugh asked City Attorney Castleberry to address the council and <br /> inform them of his findings regarding the legality of issuing an easement to <br /> American Silica on the extreme north portion of the North Complex. Mr. <br /> Castleberry said he visited extensively with legal council from the Arkansas <br /> Municipal League and he said all his concerns have been satisfied. He said <br /> American Silica has promised to donate 6-10 acres of land located south of the <br /> proposed railroad and adjacent to the North Complex for the easement rights. <br /> They also will pay for the costs associated with the relocation of the walking trail, <br /> any costs associated with the relocation of any and all utility lines resulting from <br /> the rail line, the construction of an 8' high chain link fence along the south line of <br /> the proposed rail line and compensate the city for the value of any trees <br /> removed. He also said the only decision before the council tonight was to give <br /> the Mayor authority to enter into the necessary agreements and contracts to <br /> grant American Silica legal interest for a railroad across the north end of the <br /> North Complex and to make sure all the stipulations discussed are in the legal <br /> documents. Mayor Elumbaugh then opened the floor for citizens to comments <br /> regarding the proposed American Silica plant project. Several citizens spoke and <br /> made their concerns known to the council. Mr. Dan Cook, representative for <br /> American Silica, addressed the council and citizens with their concerns. After <br /> further discussion, Councilmember Krug moved to give the Mayor authority to <br /> enter into the necessary agreements and contracts on behalf of the City to grant <br /> American Silica, LLC and/or Missouri Northern Arkansas Railroad an appropriate <br /> legal interest for a railroad across the north end of the North Recreational <br />
