ORDINANCE NO. C O 14-' /a-01� <br /> AN ORDINANCE AUTHORIZING WITHDRAWAL FROM THE <br /> INTERLOCAL AGREEMENT ON LAW ENFORCEMENT,DECLARING AN <br /> EMERGENCY,AND FOR OTHER PURPOSES. <br /> WHEREAS, the City of Batesville and Independence County currently <br /> participate in an Interlocal Agreement which sets out their respective rights and <br /> obligations regarding law enforcement within the county; <br /> WHEREAS, the present version of the Interlocal Agreement was adopted by the <br /> City of Batesville on July 10,2012, and is set to expire in July of 2017; <br /> WHEREAS, in efforts to make a decision with respect to continued participation <br /> in the Interlocal Agreement, the current status of police protection has been examined <br /> and the findings of a feasibility study have been reviewed. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF <br /> BATESVILLE, ARKANSAS: <br /> Section 1. Pursuant to Section A of the Interlocal Agreement, the City of <br /> Batesville hereby elects to withdraw from the Agreement, terminating the same. <br /> Section 2. The City Attorney is directed to give written notification to <br /> Independence County as required by the Agreement. <br /> Section 3. Per the terms of the Interlocal Agreement, it shall terminate at the <br /> end of the six(6)month period following notification. <br /> Section 4. This ordinance repeals any ordinances or parts of ordinances in <br /> conflict herewith. <br /> Section 5.
