ORDINANCE NO. 2014 - <br /> AN <br /> 014 -AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND <br /> AUTHORIZE THE BATESVILLE UTILITY DEPARTMENT TO CONTRACT FOR <br /> TRANSITION OF WASTEWATER FLOW FROM THE PUMP SYSTEM TO THE <br /> RECENTLY CONSTRUCTED GRAVITY TUNNEL <br /> WHEREAS, the City of Batesville has continued to work on wastewater improvements <br /> pursuant to a measure approved by the voters in 2009; <br /> WHEREAS, the Batesville Utility Department, in the early phases of implementing <br /> wastewater improvements, contracted for the construction of a gravity tunnel to replace the <br /> existing pump system; <br /> WHEREAS,the Batesville Utility Department has continued work on the project, and <br /> the current contractor is required to demolish the pump system infrastructure in order to complete <br /> its scope of work; and <br /> WHEREAS,the gravity tunnel must be in operation before the existing pump system can <br /> be demolished. <br /> NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF <br /> BATESVILLE,ARKANSAS: <br /> Section 1.That the transition from the current pump system to the gravity flow system is <br /> a time-sensitive project that must be performed without delay in order for the remainder of the <br /> overall project to proceed. <br /> Section 2. That the transition project at issue was initially slated for inclusion in a much <br /> larger contract upon which the City of Batesville will accept bids,but the contract documents and <br /> bid specifications for that larger overall project have been delayed. <br /> Section 3. That the Batesville Utility Department should be allowed to contract with <br /> Rosetta Construction for the project of transitioning from the current pump system to the gravity <br /> flow system at a cost of$300,000.00, more or less. <br /> Section 4. That the City Council in accordance with the terms of A.C.A. Section <br /> 14-58-303 hereby waives the requirement of competitive bidding and authorizes the Batesville <br /> Utility Department to contract for the transition from the pump system to the gravity system for <br /> the price set forth in Section 3 above. <br /> { <br /> Section 5. EMERGENCY CLAUSE: It is further found that due to the immediate need <br /> to acquire the above utility program, an emergency is declared to exist and this ordinance being <br /> necessary for the preservation of the public peace,health and safety shall take effect from and <br />
