NOVEMBER 9, 2009
The Batesville City Council met in regular session on November 9, at 5:30 PM at
the Municipal Building. Mayor Rick Elumbaugh presided over the meeting.
Councilmember Henley gave the invocation. Upon roll call the following
councilmembers answered present: Tommy Bryant, Margarett Henley, Davy Insell,
Fred Krug, Doug Matthews, Matt McDonald, Richard O'Neal, and David Shetron. The
City Clerk was also present. City Attorney Scott Stalker was absent.
Councilmember O'Neal moved to approve the minutes from the previous meeting
and Councilmember Shetron seconded. All voted for.
Councilmember Shetron moved to approve the prepared agenda as amended.
Councilmember Bryant seconded and all voted for.

NEW BUSINESS
A) RECOGNIZE THE LADY PIONEERS CROSS COUNTRY TEAM
The Mayor read a proclamation recognizing the Lady Pioneers Cross Country
Team for the recent AAAAA State Championship. The Lady Pioneers have won the
State title for six years in a row. Coach Diane Treadway introduced each team member
and Mayor Elumbaugh presented them with a proclamation.
B) CONSIDER A TAX BACK RESOLUTION FOR TOWNSENDS, INC.
Councilmember Bryant introduced a resolution endorsing Townsends, Inc. to
participate in the Tax Back Program. City Clerk Johnston read the resolution in full.
Councilmember Shetron moved to adopt the resolution and Councilmember Bryant
seconded. All voted for and the resolution was given #2009-11-01-R.
C) ENGINEER'S REPORT
Mayor Elumbaugh said City Engineer Damon Johnson was out all day and is still
with the Engineering firm McGoodwin, Williams and Yates regarding the Wastewater
Treatment Plant improvements.
D) REVIEW PAID BILLS REPORT
The council was given a copy of the paid bills report for October, 2009 for review.
MAYOR COMMENTS
Mayor Elumbaugh asked Safety Director Sharon Taylor and
Cemetery/Landscape Supervisor Johnny Abbott to addresses the council regarding a
recent chain saw safety class. Ms. Taylor thanked Councilmember Bryant for
recommending the class and the council for allowing the City employees to attend. She
said approximately 25 City employees attended the class and said the safety training
was excellent. Mr. Abbott said he learned a lot and his employees were extremely
attentive and asked lots of questions. He said the class not only trained on how to
prevent accidents but what to do in case of an accident. Ms. Taylor and Mr. Abbott both
said the class was very beneficial and helps to instill Safety in our employees.
Mr. Abbott then addressed the council with an update on the Christmas lights.
He said his crew was doing a great job and they hope to grow the light display every
year.
Mayor Elumbaugh said White River Medical Center bid $165,000.00 and was the
only bid for the property located at the intersection of Sidney and Gray's Streets and
currently houses the Cemetery Shop. Councilmember Bryant moved to accept the bid
from WRMC and Councilmember Henley seconded. All voted for.
The Mayor said he had been contacted by Lyon College requesting two street
lights near the baseball field and their apartments on Row and Boles Streets. He said
the area was very dark and there are existing poles to place the lights. Councilmember
O'Neal moved to set the street lights and Councilmember Bryant seconded. All voted
for.
Mayor Elumbaugh said City Engineer Johnson had received two statements of
qualification from engineering firms and was expecting two more. Councilmember
Bryant moved to authorize City Engineer Damon Johnson to proceed with choosing a
qualified engineering firm for the Levy certification as required by FEMA.
Councilmember O'Neal seconded and all voted for.
Mr. Nick Baxter addressed the council to make a public statement regarding
water meters. Mr. Baxter said when it rains, dirt and sediment settles on top of the
water meter. Meter readers wipe off enough to read the meter but with as much rain as
we have had this year, it looks as if the meters are not being read. Mr. Baxter wanted to
assure the public that the meters were being read.
Mayor Elumbaugh asked for out of state approval for fireman Cam Russell. Mr.
Russell will be traveling to South St. Paul, MN for a class on Pump Repair and
Maintenance. The class is January 10th through the 15th and will be paid for out of Act
833 funds. Councilmember Bryant moved to approve the out of state travel.
Councilmember Insell seconded and all voted for.
Mayor Elumbaugh commented of the City first Health and Wellness fair. Over 90
employees and 4 councilmember attended. The Mayor said he hoped the fair will help
to bring health awareness to our employees and community.
The Mayor announced that the City will be receiving a trails grant in the amount
of$40,900.00. The new trail will be a 12' wide asphalt trail beginning at the Mickey
Mouse Pool and run to the end of the Fitzhugh Ball Park.

COUNCIL COMMENTS
Councilmember Bryant commented on the chain saw safety class and said he
lost a friend due to a chain saw accident. He commended the employees for attending
the class and thanked the Ms. Taylor for her efforts in promoting safety in the City of
Batesville.
ADJOURNMENT
There being no further business, Councilmember Matthews moved that the
meeting be adjourned and Councilmember Insell seconded. All voted for.
