HomeMy WebLinkAbout2009-03-06-SPECIAL MINUTES OF COUNCIL SPECIAL MEETING MARCH 6, 2009 The Batesville City Council met in special session on March 6, at 1:00 PM at the Municipal Building. Mayor Rick Elumbaugh presided over the meeting. Upon roll call the following councilmembers answered present: Tommy Bryant, Margarett Henley, Davy Insell, Fred Krug, Doug Matthews, Matt McDonald, Richard O'Neal, and David Shetron. Also present were the City Clerk and the City Attorney. Councilmember Matthews moved to approve the prepared agenda. Councilmember Shetron seconded and all voted for. NEW BUSINESS (A) CONSIDER AN ORDINANCE TO ADOPT CHANGES IN THE CITY OF BATESVILLE/INDEPENDENCE COUNTY INTERLOCAL LAW ENFORCEMENT AGREEMENT Councilmember McDonald introduced an ordinance to adopt changes in the City of Batesville/Independence County Interlocal Law Enforcement Agreement. Mr. Stalker read the ordinance in full. The council discussed the amendment which provides for the metro traffic control officer approved in the 2009 budget. Councilmember Shetron moved to suspend the rules and wave the second and third readings. Councilmember Insell seconded and the roll call count was 8 for and 0 against. Councilmember O'Neal moved to adopt the ordinance and Councilmember Insell seconded. The roll call count was 8 for and 0 against. The ordinance was given #2009-3-1. Mr. Stalker read the emergency clause and Councilmember Matthews moved to adopt. Councilmember O'Neal seconded and the roll call count was 8 for and 0 against. (B) CONSIDER AN ORDINANCE TO WAIVE COMPETITIVE BIDDING FOR RUNWAY LIGHTS OF THE BATESVILLE MUNICIPAL AIRPORT Councilmember Matthews introduced an ordinance to waive competitive bidding for runway lights for the Batesville Municipal Airport. Mr. Stalker read the ordinance in full. Mr. Karl Kemp with the Airport Commission answered questions from the council regarding the purchase. Mr. Kemp said there was only one company that made LED runway lights. The airport has applied for an 80/20 grant for the lights. Councilmember Bryant moved to suspend the rules and wave the second and third readings. Councilmember Matthews seconded and the roll call count was 8 for and 0 against. Councilmember Bryant moved to adopt the ordinance and Councilmember Matthews seconded. The roll call count was 8 for and 0 against. The ordinance was given #2009-3-2. Mr. Stalker read the emergency clause and Councilmember Bryant moved to adopt. Councilmember O'Neal seconded and the roll call count was 8 for and 0 against. MAYOR'S COMMENTS Mayor Elumbaugh said the City's vehicle insurance with the Arkansas Municipal League denied a recent claim for an accident that involved brush falling out of a City truck and hitting a car. The Municipal League said since the brush hit the road and then the vehicle hit the brush, they are not responsible to pay the claim. If the brush had hit the vehicle before it hit the road, they would be responsible. The council asked the Mayor to file an appeal to the League. ADJOURNMENT There being no further business, Councilmember McDonald moved that the meeting be adjourned. Councilmember Shetron seconded and all voted for. RICK ELUMBAUGH, MAYOR DENISE M.
