MARCH 24, 2009
The Batesville City Council met in regular session on March 24, at 5:30 PM at the
Municipal Building. Mayor Elumbaugh called the meeting to order. Councilmember
Matthews gave the invocation. Upon roll call, the following council answered present;
Thomas Bryant, Margarett Henley, Davy Insell, Fred Krug, Doug Matthews, Matt
McDonald, Richard O'Neal and David Shetron. The City Attorney and City Clerk were
also present.
Councilmember Insell moved to approve the minutes from the previous meeting.
Councilmember Shetron seconded and all voted for.
Councilmember Matthews moved to approve the prepared agenda as amended.
Councilmember Bryant seconded and all voted for.

NEW BUSINESS
(A) RECOGNIZE MR. DAVID McQUARY FOR FUND RAISING EFFORTS
Mayor Elumbaugh recognized Mr. David McQuary for his community service in
raising funds for schools, churches and local orginizations. Mr. McQuary recently
raised over $4,000. for the Special Olympics Polar Bear Plunge.
(B)MR. ROBERT SANDERS REGARDING SEWER OVERFLOW RUINING
EQUIPMENT
Mr. Robert Sanders addressed the council regarding a sewer overflow that
ruined a piece of Tool and Die equipment that he had stored in a storage building. Mr.
Sanders said he was not made aware of the overflow until August 2008 but the incident
occurred on June 19, 2008. According to Engineer Damon Johnson and Construction
Supervisor Red Davis, the backup was due to a blockage in the line and it is the City's
responsibility. Mr. Sanders said to replace the bearings on the equipment is $750.00,
$1,000.00 in labor and approximately $550.00 for shipping. Councilmember McDonald
moved to pay $1,750.00 plus shipping for the repair and Councilmember Henley
seconded. All voted for.
(C)CONSIDER HISTORIC DISTRICT PRESERVATION ORDINANCE
Councilmember Insell introduced an ordinance to establish procedures for the
protection and preservation of the character of the properties within the Historic District.
Dr. Terrell Tebbetts addressed the council with background on the proposed
ordinance. After a discussion, Councilmember Matthews moved to read the first
reading by title only. Councilmember Shetron seconded and the roll call count was 8
for and 0 against. Mr. Stalker read the ordinance by title only. The ordinance will be
placed on the next agenda for the second reading.
(D)ENGINEER'S REPORT
City Engineer Mr. Damon Johnson addressed the council with his Engineer's
report.
(E)EXECUTIVE SESSION
Councilmember Bryant moved to go into executive session and Councilmember
Insell seconded. All voted for.
No decisions were made in executive session
(F) REVIEW FEBRUARY 2009 FINANCIALS
The council reviewed the February 2009 financials.
COMMENTS FROM THE MAYOR
Mayor Elumbaugh asked the Clerk to inform the council of a fixed asset disposal.
Metro Unit#M-32, 1998 Ford Crown Victoria is at the city yard being used for parts and
has been removed from the City's fixed assets.
Mayor Elumbaugh praised the citizens of Batesville for their overwhelming
support of the 10 Wastewater Sales Tax. The tax passed by 93%.
The Mayor finished his comments announcing several upcoming events within
the City and Independence County.

There being no further business, Councilmember Matthews moved that the
meeting be adjourned. Councilmember O'Neal seconded and all voted for.
