SEPTEMBER 25, 2007
The Batesville City Council met in regular session on September 25, at
5:30 PM at the Municipal Building. Mayor Rick Elumbaugh presided over the
meeting. Mayor Elumbaugh announced to the council that one of our
employees, Ms. Barbara Brooks with Animal Control passed away this morning.
He said Ms. Brooks has been with the City for 13 years and asked the council to
remember the Brooks family during this time. Councilmember Matthews gave
the invocation. Upon roll call the following councilmembers answered present:
Fred Krug, Doug Matthews, Matt McDonald, Trula Pectol, David Shetron,
Stephen Smart and Paula Terrell. The City Clerk was also present.
Councilmember R.L. Carpenter and the City Attorney Scott Stalker were absent.
Councilmember McDonald moved to approve the minutes from the
previous meeting and Councilmember Terrell seconded. All voted for.
Councilmember Shetron moved to approve the prepared agenda.
Councilmember Matthews seconded and all voted for.

NEW BUSINESS
A) DOUGLAS TATE REGARDING FLOODING PROBLEMS
Mr. Douglas Tate along with Mr. Tim Johnson addressed the council
regarding flooding in their neighborhood in the Goff Addition. Mr. Tate said he
has lived at his residents for 2 years and has had his house flooded
approximately 10 times, 6 of those being since January 2007. Mr. Tate and Mr.
Johnson said they believe a lot of the problem is the recent work done at the
Pioneer Football field and paving on new parking lot at the High School. Mayor
Elumbaugh said the City has just recently done some work in the neighborhood
but there has not been a substantial rain since the work has been completed.
The Mayor and the Council said they are aware of the flooding problems that are
all over the City. The City's Engineer, Mr. Damon Johnson is working with the
Planning Commission with the new Sub-Division regulations and he said they are
addressing drainage issues.
B) MASTER GARDENERS
Ms. Sherry Adcox and Ms. Ann Luster addressed the council regarding
Pioneer Cemetery. The Master Gardeners have in the past done work in the
cemetery, however they said that they needed funds and manpower to beautify
the cemetery. They are proposing to set up a Friends of Pioneer Cemetery non-
profit 501 C-3 fund and have fund-raisings to help with the maintenance of the
cemetery. Since the Pioneer Cemetery property belongs to the City, they are
asking for the City's permission. Councilmember Matthews moved to allow the
group to establish the non-profit fund and help maintain and beautify the
cemetery. Councilmember Pectol seconded. All voted for.
C) CUB SCOUTS PROPOSAL
Mayor Elumbaugh said the Cub Scouts have not yet brought a proposal to
use the old Animal Control building at Riverside Park.
D) CONSIDER INCREASE WATER SERVICE FEES
Mr. Larry Tharnish and Mr. Jerry Jeffery with the Batesville Water Utilities
addressed the council regarding increasing water service fees. They discussed
the rates and made a few changes. An ordinance will be prepared for the next
meeting to adopt the rates.
E) CITY AND WATER FINANCIALS
The council was given a copy of the City and Water financials for the
month ending August, 2007.
CEMETERY RESOLUTION
The council considered a cemetery resolution for John R. Myers for
$1,600.00, resolution #2007-269-1. Councilmember Smart moved to accept the
resolution and Councilmember Matthews seconded. All voted for.
COMMENTS FROM THE MAYOR
Mayor Elumbaugh asked the council to approve out of state travel for Mr.
Johnny Coles and Mr. Marty Thompson to go to Decatur, Alabama for their
annual stoplight training. Councilmember Terrell moved to approve the out of
state travel and Councilmember Smart seconded. All vote for.
The Mayor said he was expecting the legal description of the land for the
new fire station and hopes to close on the property soon.
The Mayor reported on the recent visit with the dignities from our Sister
City, Putian City, China. He said everything went well and he thanked
Councilmembers Matthews and Terrell for their hard work getting ready for our
visitors and also the local business for all their help and support.

There being no further business, Councilmember Shetron moved that the
meeting be adjourned. Councilmember Matthews seconded and all voted for.
