AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS MAP; AND FOR
OTHER PURPOSES.
WHEREAS, Jarrod Krepps, doing business as Aerotech Machine Corporation, has requested that his
property, located at 2583 North Central Avenue, be re-zoned so as to align the zoning classification with
the actual and proposed use of said property; and,
WHEREAS, the Batesville Planning Commission has conducted a properly advertised public hearing
on May 5, 2014; and,
WHEREAS, the Batesville Planning Commission has reviewed the relationship of this property with
the Coinprehensive Plan and determined that the existing and proposed uses are consistent with said Plan;
and,
WHEREAS, the Batesville Planning Commission has recommended that the requested amendment
to the Zoning Districts map be approved by the City Council.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BATESVILLE, ARKANSAS THAT THE BATESVILLE ZONING DISTRICTS MAP IS
HEREBY AMENDED AS FOLLOWS:
From Single-Family Residential (R-1)to Light Industrial [I-1]
A tract of land being part of the NW 1/4 of Section 8, Township 13 North, Range 6 West of the 5th
Principal Meridian in Independence County, Arkansas, more particularly described as follows:
Commencing at the Northwest corner of said Section 8; thence run S 87°54'39" E a distance of
523.72 feet to the west right-of-way line of Arkansas Highway 69, the same being North Central
Avenue; thence run along said west right-of-way line as follows: S 07°00'20" E a distance of 12.42
feet; S 32° 28'l 4" E a distance of 100.12 feet; S 51°04'36" E a distance of 8.81 feet; S 51°04'36" E a
distance of 100.48 feet; S 35°28'05" E a distance of 19.59 feet; S 37°22'00" E a distance of 29.84 feet
to the Point of Beginning; thence continue along said right-of-way line as follows: S 37°22'00" E a
distance of 55.99 feet; S 24°18'27"E a distance of 109.89 feet; S 44°55'03" E a distance of 62.64 feet;
S 46°37'22" E a distance of 42.42 feet; S 49°37'07" E a distance of 77.23 feet; thence leaving said
west right-of-way line, run N 86°06'11" W a distance of 912.52 feet; thence run N 01°53'49" E a
distance of 262.11 feet;thence run S 88°00'30" E a distance of 690.66 feet to the Point of Beginning.
IF ANY PORTION OR PORTIONS OF THIS ORDINANCE ARE DEEMED OR HELD TO
BE INVALID, SUCH INVALIDITY SHALL NOT EFFECT THE REMAINING PORTION OR
PORTIONS OF THIS ORDINANCE.
