SEPTEMBER 12, 2006
The Batesville City Council met in regular session on September 12, at
5:30 PM at the Municipal Building. Mayor Joe Biard presided over the meeting.
Ms. Nicky Baker, a student from Lyon College gave the invocation. Upon roll call
the following councilmembers answered present: R.L. Carpenter, Fred Krug,
Doug Matthews, Jerry Pectol, David Shetron, Stephen Smart and Paula Terrell.
Also present were the City Clerk and the City Attorney. Councilmember Mynatt
was absent.
INTRODUCTION OF LYON COLLEGE SCOTS AND PIPERS BASKETBALL
TEAMS
Councilmember Krug introduced Lyon College Pipers Coach Tracy Lang
and Scots Coach Kevin Jenkins to the council who in turn introduced their
players for this year's basketball season. The coaches invited the council to
attend their games and support the Scots and Pipers and then gave the Council,
Mayor and Clerk t-shirts.
COMMENTS FROM CITIZENS
Mayor Biard opened the floor for comments from citizens. Mr. Tommy
Bryant addressed the council and said at a recent planning meeting, the Master
Street Plan was discussed. Mr. Bryant said if the council was going to consider
making Main and College two way streets, they might want to do so now as the
Hwy Commission is in the planning stages for the widening of Hwy 167 from
Main Street to Cave City.
Ms. Margaret Henley gave the council a handout and spoke briefly about
the Sonic issue.
Ms. Brenda Wood also gave the council a handout regarding her recent
wage discrepancy with the Water Utility.
ROUTINE BUSINESS
Councilmember Pectol moved to approve the minutes from the previous
meeting and Councilmember Terrell seconded. All voted for.
UNFINISHED BUSINESS
***CODE ENFORCEMENT HEARINGS
Mayor Biard opened the public hearing for condemnation for the following
properties; 858 Neeley, 921 Elm, 1089 Grace, 445 Wilson, and 909 Oak Streets.
Code Enforcement Officer showed pictures to the council of the first property at
858 Neeley. The property owner Karen Crawford was present as well as Kathy
Crawford who is trying to buy the property. Karen Crawford said she did not
know how long it would take for the purchase of the property to be complete
because it is tied up in an estate. She said she could paint the outside and clean
up the inside of the house. Councilmember Shetron moved to give the property
owner 60 days to make noticeable improvements to the property.
Councilmember Carpenter seconded and all voted for.
The next property being considered for condemnation is located at 921
Elm Street. Mayor Biard said he has located the bank that he believe now owns
the property. City Attorney Stalker said the condemnation process will need to
start over with the notification of the bank. Councilmember Matthews moved to
notify the bank and start the condemnation process. Councilmember Terrell
seconded and all voted for.
The next two properties are located at 445 Wilson and 1089 Grace. After
a review of the pictures and a discussion, Councilmember Terrell moved that Mr.
McClure issue citations for unsightly properties to Connie Blevins, owner of the
properties. Councilmember Krug seconded and all voted for.
The last property for condemnation consideration is located at 909 Oak
Street. Mr. Larry Little, owner of the property was present. Mr. McClure showed
pictures of the property that included holes in the foundation and a broken
window. Mr. Little pointed out that he had put new vinyl siding and a new roof on
the house. He said he had new windows but has not had time to install them.
Councilmember Pectol moved to give Mr. Little 30 days to make repairs to the
house and allow Mr. McClure inside to inspect the interior. Councilmember
Matthews seconded and all voted for.
The council also discussed two other properties. Councilmember Pectol
moved to issue a citation to Ms. Julie Hallmark at 206 Lilly Street for unsightly
property and Councilmember Matthews seconded. All voted for.
Councilmember Carpenter moved to issue a citation to Bill Rogerson at 375
Baker Street for unsightly property. Councilmember Pectol seconded and all
voted for.
***THIRD READING OF PROPOSED SMOKE-FREE PARKS AND
RECREATION ORDINANCE
Councilmember Smart moved to read the third reading by title only and
Councilmember Terrell seconded. The roll call count was 7 for and 0 against.
Mayor Biard read the ordinance by title and Councilmember Matthews moved to
adopt the ordinance. Councilmember Krug seconded and the roll call count was
7 for and 0 against. The ordinance was given No. 2006-9-1.
***THIRD READING OF A PROPOSED ORDINANCE TO EXEMPT THE CITY
FROM SHIELDED LIGHTING ACT.
Councilmember Matthews moved to read the third reading by title only and
Councilmember Pectol seconded. The roll call count was 7 for and 0 against.
The Mayor read the ordinance by title and Councilmember Matthews moved to
adopt the ordinance. Councilmember Shetron seconded and the roll call count
was 7 for and 0 against. The ordinance was given No. 2006-9-2.
Then, Councilmember Matthews moved that when ever possible street
lights are to be replaced with shielded lights. Councilmember Smart seconded
and all voted for. The council plans to work on a lighting ordinance for the city.
NEW BUSINESS
***CONSIDER AN ORDINANCE TO PROHIBIT THE OPERATION OF ALL
TERRAIN VEHICLES ON ALL CITY PROPERTIES
Councilmember Shetron introduced an ordinance that would prohibit the
operating of all terrain vehicles (ATV's) on all properties owned by the City of
Batesville. Mayor Biard read the ordinance in full and Councilmember Shetron
moved to suspend the second and third readings. Councilmember Krug
seconded and the roll call count was 5 for (Carpenter, Krug, Matthews, Pectol
and Shetron) and 2 against (Smart and Terrell). The motion failed. The
ordinance will be placed on the next meeting's agenda.

COMMENTS FROM COUNCIL MEMBERS
Councilmember Smart reported on the recent Cemetery Committee
meeting and Councilmember Matthews asked the council to go by and look at
the possibility of placing a street light in the middle of the block around 2020
Porter.

COMMENTS FROM THE MAYOR
Mayor Biard reminded the council of the annual Interlocal Law
Enforcement meeting scheduled for 3:00 PM Thursday, September 14.
There being no further business, Councilmember Krug moved that the
meeting be adjourned and Councilmember Shetron seconded. All voted for.
