JULY 11, 2006
The Batesville City Council met in regular session on July 11, at 5:30 PM
at the Municipal Building. Mayor Joe Biard presided over the meeting.
Councilmember Krug gave the invocation. Upon roll call the following
councilmembers answered present: R.L. Carpenter, Fred Krug, Doug Matthews,
Dana Mynatt, Jerry Pectol, David Shetron, Stephen Smart and Paula Terrell.
Also present were the City Clerk and the City Attorney.
COMMENTS FROM CITIZENS
Mayor Biard opened the floor for comments from citizens. There being
none, the Mayor closed the floor.
ROUTINE BUSINESS
Councilmember Smart moved to approve the minutes from the previous
meeting. Councilmember Mynatt seconded and all voted for.
UNFINISHED BUSINESS
"STATE AND LILLY STREETS — CODE ENFORCEMENT
Code Enforcement Officer Chad McClure addressed the council regarding State
and Lilly Streets. Ms. Julie Hallmark addressed the council regarding her
property at 206 Lilly Street. Ms. Hallmark said she has been taking care of her
mother who is ill. She said she had cleaned up around the house and mowed
her yard. She said the items on the carport have been straightened up and a
tarp was up around the items. Mayor Biard said he checked with Marcus Bowers
about the cost to remove the items. Mr. Bowers said it would cost $1,500 to
$1,700 to enclose the carport or $2,500 to have it removed and a monthly
storage cost of$65. After a lengthy discussion, Councilmember Terrell moved
that the items be removed from the carport or siding be put up around the carport
to enclose it by August 31. Councilmember Krug seconded and all voted for.
"CONSIDER AN ORDINANCE AMENDING THE ZONING CODE
CONCERNING SEXUALLY ORIENTED BUSINESSES
Councilmember Carpenter introduced and ordinance that would amend
the zoning code concerning sexually oriented businesses. Councilmember
Matthews moved to read the first reading by title only. Councilmember Carpenter
seconded and the roll call was 8 for and 0 against. Councilmember Matthews
moved to suspend the second and third readings. Councilmember Mynatt
seconded and the roll call count was 8 for and 0 against. Councilmember Mynatt
moved to adopt the ordinance and Councilmember Matthews seconded. The roll
call count was 8 for and 0 against. The ordinance was given #2006-7-1.
NEW BUSINESS
"CONSIDER AN ORDINANCE EXEMPTING BATESVILLE FROM
SHIELDED OUTDOOR LIGHTING ACT
Councilmember Carpenter introduced an ordinance that would exempt the
City of Batesville from Act 11 of 2006 concerning shielded outdoor lighting.
Mayor Biard read the ordinance in full for the first reading. The ordinance will be
considered at the next meeting.
"EXECUTIVE SESSION
Councilmember Smart moved to go into executive session and
Councilmember Terrell seconded. All voted for. Upon returning from executive
session Councilmember Terrell moved to appoint Mrs. Nina Womack to the
Planning Commission. Councilmember Mynatt seconded and all voted for
except Councilmember Krug. Mrs. Womack will fill the unexpired term of Mickey
Powell. The term will end 6/10/07.
"CEMETERY RESOLUTION
The council considered a cemetery resolution for Deanne Coleman,
#2006-192-1 for$600.00. Councilmember Smart moved to accept and
Councilmember Carpenter seconded. All voted for.
COMMENTS FROM DEPARTMENT HEADS
None
COMMENTS FROM COUNCIL MEMBERS
Mayor Biard asked Parks Director Randy Palmer to come before the
council for questioning as per request from Councilmember Terrell. Several of
the council asked Mr. Palmer questions ranging from the storage of parks
mowers, lighting issues on the walking track and parking lots and revenue from
the pools.

COMMENTS FROM MAYOR
Mayor Biard informed the council that during the past week, we had two
claims for window breakage from city mowers and weed-eaters. The first claim
came from a vehicle parked at Darrell's Foreign Car Repair next to the Gray's
Addition to Oaklawn Cemetery. According to the police report, a cemetery
worker was mowing in the Gray's Addition and a rock broke out the back glass of
a van parked at the business. The Mayor said all indications are that the city
worker did the damage. The repair cost is $267.05. The second claim came
when a city worker was weed-eating at the intersection of Harrison and Boswell
Street when a rock hit a passing vehicle and broke out a side glass. The city
worker said the incident did happen. The repair cost is $159.80. Councilmember
Smart moved to pay for both repairs. Councilmember Mynatt seconded and all
voted for.
The Mayor told the council that the bid openings for the Animal Control
facility were all over what the city has to construct the facility. He said they are in
the process of negotiating with the low bidder.
The council was given a copy of the May 2006 financial statement.
There being no further business, Councilmember Matthew moved that the
meeting be adjourned. Councilmember Smart seconded and all voted for.
