APRIL 11, 2006
The Batesville City Council met in regular session on April 11, at 5:30 PM
at the Municipal Building. Mayor Joe Biard presided over the meeting.
Councilmember Smart gave the invocation. Upon roll call the following
councilmembers answered present: R.L. Carpenter, John Cooke, Fred Krug,
Doug Matthews, Dana Mynatt, Jerry Pectol, Stephen Smart and Paula Terrell.
Also present were the City Clerk and the City Attorney.
COMMENTS FROM CITIZENS
Mr. Lyndal Waits addressed the council regarding the proposed smoking
ordinance that was before the council. Mr. Waits said he was concerned
because the non-smoking area includes Riverside Park and that is where the
annual Hawg Bar-B-Q is held. Mr. Waits said that most of the teams that
participate in the Bar-B-Q have people on their teams that use some form of
tobacco. He said that if the city passed the ordinance they would have to hold
the event elsewhere. He suggested that they consider putting a waver clause in
the ordinance for such events.
ROUTINE BUSINESS
Councilmember Smart moved to approve the minutes from the previous
meeting and Councilmember Terrell seconded. All voted for.
UNFINISHED BUSINESS
*THIRD READING OF AN ORDINANCE TO RAISE WATER RATES
Councilmember Cooke moved to read the third reading by title only.
Councilmember Matthews seconded and the roll call count was 8 for and 0
against. Mayor Biard read the ordinance. Utility Manager Larry Tharnish and
Commissioner Sam Cooke addressed the council regarding the two utility
ordinances. Dr. Cooke said that in light of a recent discovery of a five year under
billing to a local industry for approximately $766,000, the commission will have a
new rate study preformed and possibly ask for less of a rate increase. After a
discussion, Mayor Biard asked if there was a motion to adopt the ordinance. The
ordinance failed for the lack of a motion.
*THIRD READING OF AN ORDINANCE TO RAISE SEWER RATES
Councilmember Carpenter moved to read the ordinance by title only.
Councilmember Terrell seconded and the roll call count was 8 for and 0 against.
Mayor Biard read the title and asked for a motion to adopt the ordinance. The
ordinance failed for the lack of a motion.
*SECOND READING OF AN ORDINANCE TO PROHIBIT THE USE OF
TOBACCO PRODUCTS ON ALL PARKS AND RECREATIONAL AREAS
OWNED AND LEASED BY THE CITY OF BATESVILLE
Councilmember Smart moved to read the ordinance by title only.
Councilmember Matthews seconded and the roll call count was 8 for and 0
against. Mayor Biard read the ordinance. The council again discussed the
ordinance and it will be placed on the next agenda for the final reading.
NEW BUSINESS
*MS. CLAUDETTE PARKS REGARDING RECYCLING
Ms. Claudette Parks with the Independence County Judge's Office
addressed the council to further explain the upcoming Household Hazardous
Waste Clean-up. Ms. Parks thanked the council for their recent commitment of
$2,167.00 for the clean-up effort. She gave the council recycling stats regarding
tonnage broken down between the city and county citizens.
*NEW CITY MAP
The Mayor said Mr. Rob Middleton said he will continue to make
corrections to the new map but any new annexations, re-zones or subdivisions
will be charged at $60.00 per hour. The council discussed asking Mr. Robert
Harrington with the Water Utility to make any new additions to the map and
having a resolution prepared to set the electronic format in which new additions
must be given to the Planning Commission. Councilmember Mynatt moved to
use Mr. Middleton for new additions to the map, to send the additions quarterly,
for the Planning Commission to be responsible for sending the updates, and to
re-evaluate the situation at the end of the year. Councilmember Krug seconded
and all voted for.
The council then discussed have a public reception to "reveal" the new
map to the citizens of Batesville. Councilmember Cooke moved to have the
public reception at the next Planning Commission Meeting and Councilmember
Smart seconded. All voted for.
*CONSIDER AN ORDINANCE TO ACCEPT THE DEDICATION OF A
CITY STREET KNOWN AS DRY KILN ROAD
Councilmember Terrell introduced an ordinance that would accept Dry Kiln
Road as a dedicated city street. Mayor Biard read the ordinance and
Councilmember Smart moved to wave the second and third readings.
Councilmember Matthews seconded and the roll call count was 8 for and 0
against. The council asked Mr. Zach Mobley, who developed the street, about
his plans of extending the street and if there was a cul-de-sac at the end for fire
trucks to turn around. Mr. Mobley said they will at some point extend the road if
they develop the adjoining land. He also said there was a gravel cul-de-sac that
could be used by the fire department. Councilmember Terrell moved to adopt
the ordinance and Councilmember Matthews seconded. The roll call count was
8 for and 0 against. The ordinance was given #2006-4-1.
COMMENTS FROM DEPARTMENT HEADS
Mr. Randy Palmer, Parks and Recreation Department Supervisor,
addressed the council regarding the proposed smoking ordinance. Mr. Palmer
said he was addressing the council on behalf of citizens that use the city's parks
and have approached him about the issue. Mr. Palmer said the pools are
already smoke free inside the fenced areas but smoking is allowed outside the
fences. He said there are currently no smoking signs at the North Complex and
most of the people comply with the signs. Mr. Palmer said he did not see a
problem making Fitzhugh Park non smoking but was concerned with making
Riverside Park and the Golf Course non-smoking and if imposed how it would be
enforced.
MAYOR ANNOUNCEMENTS
Mayor Biard recognized Ms. Sherry Ridout with Loud and Clear
Productions. Ms. Ridout addressed the council and gave them information on
the 6t" Annual Spring Car and Bike Rally at Riverside Park. The event is
scheduled for May 5, 6, & 7 and expected to bring in approximately 25,000
people to Batesville. The council thanked Ms. Ridout for her hard work with this
event.
There being no further business, Councilmember Smart moved that the
meeting be adjourned. Councilmember Matthews seconded and all voted for.
