HomeMy WebLinkAbout2006-05-09 MINUTES OF COUNCIL MAY 9, 2006 The Batesville City Council met in regular session on May 9, at 5:30 PM at the Municipal Building. Mayor Joe Biard presided over the meeting. Councilmember Smart gave the invocation. Upon roll call the following councilmembers answered present: R.L. Carpenter, John Cooke, Fred Krug, Doug Matthews, Dana Mynatt, Stephen Smart and Paula Terrell. Also present were the City Clerk and the City Attorney. Councilmember Pectol was absent. CITIZENS COMMENTS Ms. Faye Martin addressed the council regarding the smoking ordinance. Ms. Martin said that she was concerned with the enforcement of the ordinance. She also said that the city parks are currently under utilized and adoption of the ordinance would only make the use of the parks even less. She also said she was a part of the Pagan Pride event at the park last year and wanted to know if a non profit organization would have to pay for the "Event Permit". Mayor Biard told Ms. Martin that she would have an opportunity to address the council during the discussion of the smoking ordinance. APPROVAL OF MINUTES Councilmember Cooke moved to approve the minutes from the previous meeting and Councilmember Carpenter seconded. All voted for. REPORTS OF SPECIAL SELECT COMMITTEES Councilmember Matthews gave a brief report from the budget committee which met last month. UNFINISHED BUSINESS CONSIDER SMOKING ORDINANCE Councilmember Mynatt introduced an ordinance that would prohibit the use of tobacco products on all parks and recreational areas owned and leased by the city. Mayor Biard read the ordinance in full. The council discussed the ordinance and opened the floor for discussion. Councilmember Mynatt moved to suspend the rules for the second and third readings. Councilmember Carpenter seconded and the roll call count was 6 for and 1 (Smart) against. Councilmember Mynatt moved to adopt the ordinance and Councilmember Carpenter seconded. The roll call was 3 (Krug, Matthews and Mynatt) for and 4 (Carpenter, Cooke, Smart and Terrell) against. The motion failed. NEW BUSINESS DETAILS ON THE NEW ANIMAL CONTROL FACILITY Mr. Herman Lee addressed the council. The council was given a drawing of the new animal control facility. DETAILS ON THE SALES TAX PROPOSAL — FIRE DEPARTMENT Fire Chief Danny Russell and Assistant Chief Brent Gleghorn addressed the council to explain the fire department's sales tax proposal. The fire department is accruing signatures from registered voters in the city limits of Batesville to place a 1/8 cent city sales tax proposal on the November General Election. The tax has a 5 year sunset clause. EXECUTIVE SESSION Councilmember Smart moved to go into executive session. Councilmember Matthews seconded and all voted for. Upon returning from executive session, Councilmember Cooke moved to reappoint Ronnie Hampton to the Planning Commission. Councilmember Matthews seconded and all voted for. Mr. Hampton's term will expire 6/10/2011. DISCUSSION OF BUDGET FOR PLANNING COMMISSION — DANA MYNATT Ms. Mynatt said the Planning Commission is in need of a budget for several areas. The city recently adopted a new map and will be making changes frequently at a cost of$60.00 per hour. Also the Planning Commission would like to hire a City Planner to help in the future growth for the City. ACTIVITY AND STATUS REPORT FROM THE SHERIFF'S DEPARTMENT The council was given a copy of the April Departmental Activity and Status Report from the Sheriff's Department. PAID BILLS REPORT The council was given a copy of the April paid bills report. COMMENTS FROM COUNCIL MEMBERS Councilmember Smart gave the council a quote for a Dell 2400MP Projector. The quite was $1,633.42. Councilmember Mynatt moved to purchase the projector and Councilmember Carpenter seconded. All voted for. NOTIFICATION OF TRANSFERS AND DISPOSALS FROM FIXED ASSETS The City Clerk notified the council of the following transfers and disposals from the City's fixed assets; 1991 Bronco from Streets to Cemetery Flatbed Dump Truck from Sanitation to Streets John Deere F725 mower from Streets to Cemetery John Deere GT245 mower from Cemetery to Streets Dewalt drill —junked out of Streets There being no further business, Councilmember Matthews moved that the meeting be adjourned.
