ORDINANCE
AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS MAP; AND FOR
• OTHER PURPOSES.
WHEREAS, Zack Mobley and Howard House have requested that their properties, described
more fully below, be re-zoned so as to align the zoning classification with the proposed use of said
properties and be consistent with the Comprehensive Plan; and,
WHEREAS, the Batesville Planning Commission has conducted a properly advertised public
hearing on August 5,2013; and,
WHEREAS, the Batesville Planning Commission has reviewed the relationship of this property
with the Comprehensive Plan; and,
WHEREAS, the Batesville Planning Commission has recommended that the requested
amendment to the Zoning Districts map be approved by the City Council.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BATESVILLE, ARKANSAS THAT THE BATESVILLE ZONING DISTRICTS MAP IS
HEREBY AMENDED AS FOLLOWS:
From Single Family Residential(R-1)to Commercial Community(C-1);
Tract 1. Commencing at the southwest corner of the SW '/4, NE '/4, Section 14, T13N, R6W;
thence S89°54'21"E along the south line of said SW '/4,NE 1/4, 458.63' to the point of beginning;
thence continuing along said south line of the SW ``/4, NE '/4, S89°54'21"E, 527.05'; thence
S00005'39"W, 116.83'; thence S27°48'53'E, 142.78'; thence N71118'00"W, 640.37'; thence
N 18°42'00"E,40.82' to the point of beginning.
Tract 2. Commencing at the southwest corner of the SW '/4, NE ''/4, Section 14, TON, R6W;
• thence S89054'21"E along the south line of said SW '/4,NE 1/4, 985.68' to the point of beginning;
thence continuing along said south line of the SW '/4, NE '/4, S89054'21"E, 194.55'; thence
S75053'09"E, 173.57"to the south right of way line of Harrison Street;thence along said right of
way line the following: S75°53'09"E, 173.57'; S71040'57"E, 76.90';thence S63°00'27"E, 55.42'
to the west right of way line of Gap Road; thence S07°12'50"E, 217.23' along said right of way
line; thence S83°13'57"W, 143.10'; thence N27048'53"W, 765.80'; thence N00005'39"E,
116.83' to the point of beginning.
IF ANY PORTION OR PORTIONS OF THIS ORDINANCE ARE DEEMED OR HELD
TO BE INVALID, SUCH INVALIDITY SHALL NOT AFFECT THE REMAINING PORTION
OR PORTIONS OF THIS ORDINANCE.
IT IS SO ORDAINED.
