HomeMy WebLinkAbout2005-11-15 MINUTES OF COUNCIL NOVEMBER 15, 2005 The Batesville City Council met in regular session on November 15, at 5:30 PM at the Municipal Building. Mayor Joe Biard presided over the meeting. Councilmember Carpenter gave the invocation. Upon roll call the following councilmembers answered present: R.L. Carpenter, John Cooke, Fred Krug, Doug Matthews, Dana Mynatt, Stephen Smart and Paula Terrell. Also present were the City Clerk and the City Attorney. Councilmember Jerry Pectol was absent. Councilmember Matthews moved to approve the minutes from the previous meeting and Councilmember Mynatt seconded. All voted for. Councilmember Smart moved to approve the prepared agenda as amended. Councilmember Krug seconded and all voted for. PRESENTATION TO THE FIRE DEPARTMENT Mayor Biard presented to the Batesville Fire Department monies from the State of Arkansas General Improvement Funds. $5,000 was given to the Batesville Fire Department and $10,000 to the White River Fire Training Center. Mayor Biard said State Representative David Wyatt gave him the checks today to be distributed to the entities. PROPOSAL BY FAMILY VIOLENCE PREVENTION Mr. Gary Baker and Ms. Debby Shaver addressed the council regarding funding for the Family Violence Prevention. Before their presentation began, Mayor Biard said that the City was prohibited to give monies to charity organizations. With that said Mr. Baker and Ms. Shaver gave the council some general information about their organization and said that if in the future the laws change, they would like to be considered for support. DISCUSSION OF SIGN ORDINANCE Councilmember Carpenter introduced the proposed sign ordinance. Councilmember Terrell moved to place it on the first reading by title only and Councilmember Carpenter seconded. All voted for. After the reading, the council discussed the ordinance and opened the floor for audience participation. The ordinance will be placed on the next meeting's agenda for the second reading. DISCUSSION OF UNIFORM PENALTY FOR VIOLATION OF ORDINANCES Councilmember Matthews introduced an ordinance that would establish uniform penalties for violations of all City ordinances. The ordinance was read by title only. The council asked the City Attorney to look over the ordinance and give his opinion at the next meeting. REFERRAL OF REQUEST FROM PLANNING COMMISSION TO HAVE ATTORNEY STEVE GILES UPDATE THE CITY SUBDIVISION REGULATIONS The Planning Commission asked the council to consider having Attorney Steve Giles update the city subdivision regulations. Mr. Giles said he could update the regulations for less than $1,000.00 Councilmember Smart moved to hire Mr. Giles to get the subdivision regulations up to date but not to exceed $1,000.00. Councilmember Carpenter seconded and the roll call count was 6 for and 1 (Krug) against. CONSIDER 2006 BUDGET The council discussed the proposed 2006 budget. According to the news, the council is proposing a 3% pay increase and that amount is not reflected in the Metro Budget. The City Clerk said she would try to get those figures before the next meeting. The council then discussed going out for bids for the city health insurance. Councilmember Carpenter moved to go out for bids and Councilmember Mynatt seconded. All voted for. EXECUTIVE SESSION Councilmember Carpenter moved to go into executive session and Councilmember Mynatt seconded. All voted for. Upon returning from executive session, Councilmember Terrell moved to appoint Steven Lewis to the Planning Commission. Councilmember Carpenter seconded and all voted for. Mr. Lewis will replace Ms. Stephanie Isaacs. The term will run through 6/10/2009. MAYOR'S ANNOUNCEMENTS Mayor Biard informed the Council that a group of citizens from Southside have filed a petition with the County Court to hold an election on incorporation. Mayor Biard wanted to make the council aware of this and stated to the council the he believed after talking to legal representation that the group will have to have a resolution from the City to present to the County Court in order to accomplish this request. The Mayor also encouraged the council to attend the hearing if one is set. There being no further business, Councilmember Carpenter moved that the meeting be adjourned.
