HomeMy WebLinkAbout2005-05-10 MINUTES OF COUNCIL MAY 10, 2005 The Batesville City Council met in regular session on May 10, at 5:30 PM at the Municipal Building. Mayor Joe Biard presided over the meeting. Councilmember Pectol gave the invocation. Upon roll call the following councilmembers answered present: R.L. Carpenter, John Cooke, Fred Krug, Doug Matthews, Dana Mynatt, Jerry Pectol and Paula Terrell. Councilmember Mitchum was absent. Also present were the City Clerk Denise Johnston and the City Attorney Scott Stalker. Councilmember Pectol moved to approve the minutes from the previous meeting and Councilmember Carpenter seconded. All voted for. Councilmember Pectol moved to approve the prepared agenda as amended. Councilmember Matthews seconded and all voted for. CONSIDER A FOUR-WAY STOP AT 21st AND NEELEY STREETS Mayor Biard said citizens asked the city to place a 4-way stop at the intersection of 21st and Neeley Streets. Mr. McClure had a picture of the intersection for the council. The council commented that there was already a 4-way stop and 20th &Neeley and 22nd &Neeley and didn't feel the need for an additional stop signs. PROPOSED ORDINANCE BY VITAL LINK TO AMEND FRANCHISE TO ALLOW BASIC AMBULANCE FOR NON-EMERGENCY CASES AND PRESENTATION BY VITAL LINK ON THEIR SERVICE Ms. Myra Wood addressed the council with a brief presentation for Vital Link. Vital Link is a private, not for profit, public benefit ambulance service. It has been serving this community for 21 �/z years. Ms. Wood gave several statistics regarding Vital Link. Ms. Myra Wood then addressed the council regarding an ordinance that would amend ordinance 492-5-2 to comply with requirements of the Arkansas Department of Health. The ordinance would allow for basic life support ambulance service to transport patients with non-life threatening conditions. This additional service will save both Vital Link and the patients from additional costs related to full service ambulance transport. Councilmember Carpenter introduced the ordinance and the Mayor read it in full. Councilmember Carpenter moved to suspend the rules for the second and third readings and Councilmember Matthews seconded. The roll call count was 7 for and 0 against. Councilmember Carpenter moved to adopt the ordinance and Councilmember Terrell seconded. The roll call count was 7 for and 0 against. The ordinance was given 42005- 5-1. Councilmember Pectol moved to adopt the emergency clause and Councilmember Krug seconded. All voted for. PROPOSAL TO ACCEPT MOUNTAIN RIDGE PLAT IN EAGLE MOUNTAIN Mr. Steve Bell addressed the council regarding the proposed ordinance that would accept the Subdivision Plat of Mountain Ridge. The plat was review and accepted by the Batesville Planning Commission on May 2, 2005. Councilmember Pectol introduced the ordinance and Mayor Biard read the ordinance in full and Councilmember Cooke moved to suspend the rules for the second and third readings. Councilmember Krug seconded and the roll call count was 7 for and 0 against. Councilmember Terrell moved to adopt the ordinance and Councilmember Matthews seconded. The roll call count was 7 for and 0 against. The ordinance was given 42005-5-2. PRESENTATION BY BATESVILLE PARKS AND RECREATION COMMISSION Mr. Tommy Tucker with the Batesville Parks and Recreation Commission and Mr. Randy Palmer, Parks and Recreation Director addressed the council with a proposed ordinance to establish a two (2)percent tax upon the gross proceeds of Hotel and Motel accommodations and a one (1)percent tax upon the gross proceeds of restaurants, cafes, and cafeterias and similar business as defined within the City of Batesville. The tax revenues would be for advertising and promotion of the City of Batesville. Councilmember Terrell introduced the ordinance and the Mayor read it in full. The council then asked Mr. Tucker and Mr. Palmer questions regarding the ordinance and opened up the floor for comments both for and against the tax. The ordinance will be on the May 24th agenda for the second reading. DISCUSSION OF BUSINESS LICENSE Councilmember Carpenter introduced an ordinance requiring a business license of all business operating in the City of Batesville. Mayor Biard read the ordinance in full for the first reading. The ordinance will be put on the May 24th agenda for the second reading. There being no further action, Councilmember Krug moved that the meeting be adjourned and Councilmember Terrell seconded. All voted for. Joe M. Biard, Mayor Denise M. Johnston, City Clerk
