MARCH 8, 2005
The Batesville City Council met in regular session on March 8, at 5:30 PM at the
Municipal Building. Mayor Joe Biard presided over the meeting. Councilmember
Matthews gave the invocation. Upon roll call the following Councilmembers answered
present: R.L. Carpenter, John Cooke, Fred Krug, Douglas Matthews, Jim Mitchum,
Dana Mynatt, Jerry Pectol, and Paula Terrell. Also present were the City Clerk Denise
Johnston and the City Attorney Scott Stalker.
Councilmember Pectol moved to approve the minutes from the last meeting.
Councilmember Matthews seconded and all voted for.
Councilmember Terrell moved to approve the prepared agenda as amended.
Councilmember Pectol seconded and all voted for.
REPORT FROM FIRE CHIEF JAMES BOOTHBY
Fire Chief James Boothby informed the council that he was notified by the ISO
that as of May 1 Batesville will have a new fire rating of a Class 3. Batesville's current
rating is a Class 5. Chief Boothby said the City should receive an official letter from ISO
soon.
DISCUSSION WITH OFFICIALS OF FRED'S CONCERNING CONDITIONS OF
THE PROPERTY
Mr. Rick Williams with Summitt Properties addressed the council regarding the
condition of the property at the Fred's store. Mr. Williams gave the council some
background to how the store had to be moved back on the property causing the need for a
retaining wall. Mr. Williams said he agreed that the first retaining wall was not
acceptable and had to be removed. He then showed the council pictures of the new wall
and told the council the new wall was designed by an Engineer. He said he had worked
close with the landowners behind the wall and hoped that they as well as the City would
be satisfied with the new wall.
CODE ENFORCEMENT REPORT
Code Enforcement Officer Chad McClure addressed the council. The first
properties that Mr. McClure showed the council were 1351 and 1353 Lyon Street. The
property is owned by Jackie Earls. He said he talked with the owner earlier in the day
and said they were going to either renovate the houses or tear them down. He said he
would keep the council informed on the progress of the two properties. Second Mr.
McClure showed pictures of 206 Lilly. He said he wrote the owner Julie Hallmark a
warning ticket giving her 30 days to clean up the property. The time expires tomorrow,
March 9 and the landowner has taken no steps to clean up the property. The council
instructed Mr. McClure to issue Ms. Hallmark a citation. The next properties discussed
were 325 and 315 Lilly Street. The council instructed Mr. McClure to issue a warning
ticket to the owner, Mr. Clyde Lampp, to clean up the properties. And finally, 1284
Grace Street, owned by Mr. Dexter White. Mr. McClure said he went out to the property
today and Mr. White had done some work to clean up the property.
DISCUSSION CONCERNING WHAT IS REFERRED TO AS DYLAN STREET
Councilmember Carpenter moved that the properties owners, Gary Vinson, Alan
Cockrill and Chris Anderson pave, curb and gutter to city code the portion of Dylan
Street starting at Mr. Vinson's property to the end with a 100' radius Cul-de-sac at the
end. Councilmember Krug seconded and all voted for.
SHERIFF'S REPORT
The council was given a copy of the February 2005 Sheriff's Department Activity
and Status Report.
PAID BILLS REPORT
The council was given a copy of the paid bills report for February 2005.
There being no further business, Councilmember Mitchum moved that the
meeting be adjourned. Councilmember Matthews seconded and all voted for.
