HomeMy WebLinkAbout2013-10-01 ORDINANCE NO oI3-1v-0 I AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS MAP; AND FOR OTHER PURPOSES. WHEREAS, C and S Hospitality Corporation, Inc. has requested that their property, located on East Main Street, be re-zoned so as to be consistent with the actual and proposed use of said property; and, WHEREAS, the Batesville Planning Commission has conducted a properly advertised public hearing on October 7,2013,to hear comments about said request; and, WHEREAS, the Batesville Planning Commission has reviewed the relationship of this property with the Comprehensive Plan and found it to be substantially consistent with said Plan;and, WHEREAS, the Batesville Planning Commission has recommended that the requested amendment to the Zoning Districts map be approved by the City Council. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS THAT THE BATESVILLE ZONING DISTRICTS MAP IS HEREBY AMENDED AS FOLLOWS: From Light Industrial District[I-1]to Commercial Community District[C-1] A part of the Northeast Quarter of the Northwest Quarter of Section 10, Township 13 North, Range 6 West described as follows: Beginning at a point on the West right of way line of State Highway No. 25, the same being East Main Street, said point being 106 feet west and 321 feet 10'/z inches south from the quarter section corner between Sections 3 l0m said Township and Range; said beginning point being the Southeast corner of the A.D. Hill property; run thence South and with the West right of way line of State Highway No. 25 a distance of 338 feet;thence North 84 degrees West a distance of 247 feet; thence North 412 feet to a point on the South line of the property now owned by N.N. Williamson and Lorena Williamson; thence East along said South line 38 feet 5 inches to the West line of the A.D. Hill property; thence South along said West line a distance of 104 feet to the Southwest corner of the A.D. Hill property; thence East along the South line of said A.D. Hill property a distance of 208 feet 7 inches to the point of beginning. IF ANY PORTION OR PORTIONS OF THIS ORDINANCE ARE DEEMED OR HELD TO BE INVALID, SUCH INVALIDITY SHALL NOT EFFECT THE REMAINING PORTION OR PORTIONS OF THIS ORDINANCE. I'T IS SO ORDAINED.
