HomeMy WebLinkAbout2004-02-10 MINUTES OF COUNCIL FEBRUARY 10, 2004 The Batesville City Council met in regular session on February 10, at 5:30 PM at the Municipal Building. Mayor Joe Biard presided over the meeting. Councilmember Watkins gave the invocation. Upon roll call the following Councilmembers answered present: Jim Cargill, R.L. Carpenter, Robert Ford, Gerald Gaither, Jim Mitchum, Jerry Pectol, Paula Terrell and Jim Watkins. Also present were the City Clerk Denise Johnston and the City Attorney Scott Stalker. Councilmember Ford moved to approve the minutes from the last meeting. Councilmember Gaither seconded and all voted for. Councilmember Ford moved to approve the prepared agenda as amended. Councilmember Cargill seconded and all voted for. REPORT FROM SHERIFF'S DEPARTMENT Sheriff Bowers addressed the council in regards to speeding in the Eagle Mountain sub- division. Sheriff Bowers said that there were only two speed limits signs in the sub-division, one 20 MPH by the Eagle Mountain School and one other 25 MPH sign. Councilmember Watkins moved to post two signs in the sub-division for 30 MPH unless otherwise posted. The signs will be posted at the entrance of Eagle Mountain Blvd. and one on Woodmont Circle. Councilmember Carpenter seconded and all voted for. Sheriff Bowers also passed out the monthly activity sheet for the month ending January, 2004. PRESENTATION BY WELLNESS COALITION Linda Hidy and Dennis Moore with the Independence County Hometown Wellness Coalition addressed the council to inform the council what the coalition was doing in our community. Mrs. Hidy said they were trying to improve the health and quality of life in Independence County. She also challenged the council to take an active roll in their mission. Mr. Moore told the council about the health problems caused by tobacco and second hand smoke. He invited the council to hear renowned speaker Dr. Victor DeNoble on February 24, 2004. PRESENTATION BY UTILITIES DEPARTMENT Mr. Jerry Jeffery with the Batesville Water Utility introduced two utility employees who presented a slide show to the council. Mr. Larry Reeves and Jane Hurley showed the council a slid presentation that they plan to take to the local schools and civic organizations. Because of safety precautions, the water plants do not give tours. CONSIDER AN ORDINANCE TO RE-ZONE CERTAIN PROPERTY FROM R-2 TO C-1 Mayor Biard read an ordinance for the first reading that would re-zone property owned by Ms. Estelle Rucker located on Case Street from R-2 to C-1. Mr. Author Montgomery addressed the council in opposition to the re-zoning. The ordinance will be on the agenda at the next meeting. REQUEST FOR APPEAL BY GARY VINSON REGARDING PLANNING COMMISSION DECISION The Council was given a copy of a letter from Mr. Gary Vinson requesting an appeal to the City Council regarding a recent decision made by the Planning Commission. In December, 2003, the Planning Commission made a decision finding that Mr. Vinson was in violation of Ordinance No. 860, Subdivision Regulations of the City of Batesville. After a discussion with the City Attorney, Mr. Stalker said he would research the proper channels to take for an appeal and would write Mr. Vinson with his findings. REPORT FROM CODE ENFORCEMENT Code Enforcement Officer Chad McClure showed the council pictures of two locations in the City that were in need of repair. The first location was 2060 College Street. Councilmember Watkins moved to start condemnation proceedings on the property and Councilmember Mitchum seconded. All voted for. The second property was located on 1458 Byers Street. Councilmember Watkins moved to start condemnation proceedings. Councilmember Carpenter seconded and all voted for. RESOLUTION FOR INVESTMENT OF CEMETERY FUNDS Mayor Biard read a resolution that would give the mayor and city clerk authority to choose an investment representative for Oakland Cemetery funds and stocks. Councilmember Gaither moved to approve the resolution and Councilmember Pectol seconded. All voted for. The resolution was given#2004-2-1-R. FINANCIAL STATEMENT The council was given a copy of the financial statement for December 31, 2003. There being no further business, Councilmember Gaither moved that the meeting be adjourned.
