MARCH 9, 2004
The Batesville City Council met in regular session on March 9, at 5:30 PM at the
Municipal Building. Mayor Joe Biard presided over the meeting. Councilmember
Watkins gave the invocation. Upon roll call the following Councilmembers answered
present: Jim Cargill, R.L. Carpenter, Robert Ford, Gerald Gaither, Jim Mitchum, Jerry
Pectol, Paula Terrell and Jim Watkins. Also present were the City Clerk Denise Johnston
and the City Attorney Scott Stalker.
Councilmember Ford moved to approve the minutes from the last meeting.
Councilmember Cargill seconded and all voted for.
Councilmember Ford moved to approve the prepared agenda as amended.
Councilmember Gaither seconded and all voted for.
CONSIDER AN ORDINANCE TO AUTHORIZE THE FINANCING FOR A NEW
SANITATION TRUCK
Councilmember Gaither introduced an ordinance that would authorize the
financing of sanitation equipment with White River Planning and Development. Mayor
Biard read the ordinance in full. Councilmember Watkins moved to suspend the rules
and wave the second and third readings. Councilmember Ford seconded and the roll call
count was 8 for and 0 against. Councilmember Watkins moved to adopt the ordinance
and Councilmember Terrell seconded. The roll count was 8 for and 0 against. The
ordinance was given 42004-3-1. Mayor Biard said the City received one bid for the
sanitation truck from McNeilus for $145,900.00. The council gave Mayor Biard the
authority to negotiate an extended warranty for the new truck. The annual payments will
be approximately $28,000.00 annually for 5 years.
PLANS FOR AN AMPLATHEATER
Mayor Biard told the council he wanted to proceed with the building of an
amphitheater. He said the City had $250,000.00 designated for the amphitheater and he
didn't think we would be getting any additional funding from the state or federal
governments. He said he would have a drawing for the council to view soon. Parks
director Randy Palmer was present to answer questions from the council.
THIRD READING ON ORDINANCE REZONING PROPERTY OWNED BY
ESTELLE RUCKER FROM R-2 TO C-1
Mayor Biard read an ordinance to rezone property owned by Estelle Rucker from
R-2 to C-1 for the third reading. Councilmember Watkins moved adopt the ordinance
and Councilmember Cargill seconded. The roll call count was 8 for and 0 against. The
ordinance was given 42004-3-2.
PROPOSED ORDINANCE TO CONSIDER REZONING PROPERTY AT 1388
LYON STREET OWNED BY BEN EARLS
Councilmember Watkins introduced an ordinance that would rezone property at
1388 Lyon Street from R-2 to C-1. Mr. Ben Earls owns the property. Mayor Biard read
the ordinance in full for the first reading. Councilmember Cargill moved to suspend the
rules for the second and third reading. Councilmember Carpenter seconded and the roll
call count was 8 for and 0 against. Councilmember Watkins moved to adopt the
ordinance and Councilmember Pectol seconded. The roll call count was 8 for and 0
against. The ordinance was given 42004-3-3.
PROPOSED ORDINANCE TO CONSIDER REZONING PROPERTY ON THE
NW CORNER OF 14TH AND NEELEY STREETS FROM R-2- TO C-1
Councilmember Gaither introduced an ordinance that would rezone property
located on the corner of 14th and Neeley Streets from R-2 to C-1. Powell and Brodie own
the property. Mayor Biard read the ordinance in full for the first reading.
Councilmember Cargill moved to suspend the rules and wave the second and third
readings. Councilmember Gaither seconded and the roll call count was 8 for and 0
against. Councilmember Cargill moved to adopt the ordinance and Councilmember
Carpenter seconded and the roll call count was 8 for and 0 against. The ordinance was
given 42004-3-4.
CEMETERY RESOLUTION
The council considered cemetery resolution 42004-69-1 for $400.00 for Inoice
Lee Pierce, Mae Lee Wilson and Thurman Lee. Councilmember Cargill moved to adopt
the resolution and Councilmember Mitchum seconded. All voted for.
PAID BILLS REPORT
The council was given a copy of the paid bills report for February, 2004.
There being no further business, Councilmember Gaither moved that the meeting
be adjourned. Councilmember Mitchum seconded and all voted for.
