HomeMy WebLinkAbout2004-01-13L MINUTES OF COUNCIL JANUARY 13, 2004 The Batesville City Council met in regular session on January 13, at 5:30 PM at the Municipal Building. Mayor Joe Biard presided over the meeting. Councilmember Gaither gave the invocation. Upon roll call the following Councilmembers answered present: R.L. Carpenter, Robert Ford, Gerald Gaither, Jerry Pectol, Paula Terrell and Jim Watkins. Councilmembers Cargill and Mitchum were absent. Also present were the City Clerk Denise Johnston and the City Attorney Scott Stalker. Councilmember Ford moved to approve the minutes from the last meeting. Councilmember Pectol seconded and all voted for. Councilmember Ford moved to approve the prepared agenda as amended. Councilmember Gaither seconded and all voted for. SHERIFF'S REPORT The council reviewed the monthly sheriff's report for December 31, 2003. REQUEST BY UTILITIES DEPARTMENT TO REPLACE AND UPSIZE WATER MAIN IN RUDDELL HILL AREA Mr. Larry Tharnish, Utilities Manager, and Mr. Dave Stallings, Utilities Commissioner, addressed the council with a request to replace and upsize a water main in the Ruddell Hill Area. Mr. Stallings said Ruddell Hill Baptist Church was building a Family Life Center and the current water line is not sufficient. He also said the current lines runs under Hwy. 106 and has given them problems in the past. Ruddell Hill Baptist Church is paying for a portion of the materials at a cost of$1,376.00. The cost for the Water Utilities will be $830.00. Councilmember Watkins moved to approve the upgrade and Councilmember Gaither seconded. All voted for. CONSIDER AN ORDINANCE TO RE-ZONE CERTAIN PROPERTY NEAR EAGLE MTN. BOULEVARD TO STONE FLAG ROAD FROM R-1 TO C-1. Councilmember Terrell introduced an ordinance that would re-zone property belonging to Bobby and Patsy Barr from R-1 to C-1. The property runs along Harrison Street and part of Stone Flag Road. The Mayor read the ordinance and Councilmember Watkins moved to suspend the rules for the second and third readings. Councilmember Carpenter seconded and the roll call count was 6 for and 0 against. Councilmember Watkins moved to adopt the ordinance and Councilmember Carpenter seconded. The roll call count was 6 for and 0 against. The ordinance was given 4 2004-1-1. PUBLIC HEARING ON CONDEMNATION OF PROPERTY AT CHARLES AND BAYOU Mayor Biard opened the floor at 5:45 for a public hearing on the condemnation of a house located at the corner of Charles and Bayou Streets. Mr. Chris Sensabaugh, owner of the property addressed the council. Mr. Sensabaugh said at the time Mr. McClure contacted him about cleaning up the property he thought he had it sold so he told Mr. McClure that he was not going to clean it up. In the mean time, the property did not sell and he said he did mow the property about 3 times. The Mayor closed the public hearing at 5:50. The council asked Mr. Sensabaugh if he was willing to clean up the property. Mr. Sensabaugh said he was but has never been told what needed to be done. The council said there was an old refrigerator in the yard that need to be hauled off immediately. He said he would have it removed by the end of the week. The council recommended that Mr. McClure go with Mr. Sensabaugh to the property and show him exactly what needs to be repaired on the house. All agreed. CONSIDER ADOPTION OF CELL PHONE AND INTERNET POLICIES The council considered the adoption of a cell phone and Internet policies for the city's employee handbook. Councilmember Watkins moved to adopt the policies presented and Councilmember Terrell seconded. All voted for. STATE OF THE CITY As required by law, Mayor Biard gave his State of The City address. COUNCIL COMMENTS The council discussed the condition of the property at 1331 E. College Street. The condition of the property has been discussed several times but no one could remember what the last conversation was with the owners. The clerk said she would look up in the minutes and report to the council. There being no further business, Councilmember Terrell moved that the meeting be adjourned.
