HomeMy WebLinkAbout2004-02-24 MINUTES OF COUNCIL FEBRUARY 24, 2004 The Batesville City Council met in regular session on February 24, at 5:30 PM at the Municipal Building. Mayor Joe Biard presided over the meeting. Councilmember Ford gave the invocation. Upon roll call the following Councilmembers answered present: Jim Cargill, R.L. Carpenter, Robert Ford, Gerald Gaither, Jim Mitchum, Jerry Pectol, Paula Terrell and Jim Watkins. Also present were the City Clerk Denise Johnston and the City Attorney Scott Stalker. Councilmember Ford moved to approve the minutes from the last meeting. Councilmember Gaither seconded and all voted for. Councilmember Ford moved to approve the prepared agenda. Councilmember Gaither seconded and all voted for. CONSIDER SETTING WATER METER OUTSIDE CITY LIMITS Mr. Larry Tharnish with the Batesville Water Utility addressed the council with a request to set a water meter outside the city limits. Mr. Marlin Ivy on 300 Hunter Springs Road has requested the meter. Councilmember Gaither made the motion to set the meter and Councilmember Mitchum seconded. All voted for. CITY ATTORNEY OPINION REGARDING REQUEST FOR APPEAL ON DECISION BY CITY PLANNING COMMISSION City Attorney Scott Stalker addressed the council regarding a request from Mr. Gary Vinson to appeal a Planning Commission ruling to the City Council. Mr. Stalker said that the city code book regarding sub-division had no appeal process, however, Mr. Stalker said because of the complicated issue, he was advising the council to hear the appeal. Councilmember Cargill moved to hear the appeal at a public hearing set for March 23. Councilmember Carpenter seconded and all voted for. SECOND READING ON RE-ZONING REQUEST BY ESTELLE RUCKER Mayor Biard read an ordinance to re-zone certain property owned by Ms. Estelle Rucker from R-2 to C-1 for the second reading. The Mayor said the ordinance would be placed on the agenda at the next meeting for the third and final reading. FINANCIAL STATEMENT The council was given a copy of the financial statement for January 31, 2004. There being no further business, Councilmember Mitchum moved that the meeting be adjourned.
