HomeMy WebLinkAbout2003-11-25 MINUTES OF COUNCIL NOVEMBER 25, 2003 The Batesville City Council met in regular session on November 25, at 5:30 PM at the Municipal Building. Mayor Joe Biard presided over the meeting. Councilmember Ford gave the invocation. Upon roll call the following Councilmembers answered present: Jim Cargill, R.L. Carpenter, Robert Ford, Gerald Gaither, Jim Mitchum, Jerry Pectol, Paula Terrell and Jim Watkins. Also present were the City Clerk Denise Johnston and the City Attorney Scott Stalker. Councilmember Ford moved to approve the minutes from the last regular and special meetings and Councilmember Pectol seconded. All voted for. Councilmember Ford moved to approve the agenda as amended and Councilmember Cargill seconded. All voted for. PRESENTATION BY UACCB STUDENTS Mr. Jamie Swisher, a student at UACCB, addressed the council and told the council about the "Riverside Park Initiative". Mr. Swisher said the Circle K International Club at the school, a branch of the Kiwanis club, took on cleaning up the park as a school project. As of November 29, the club has picked up 675.50 pounds of garbage at Riverside Park. Mr. Swisher said the club was looking at other way to help at the park such as providing more trashcans. The Mayor and council commended Mr. Swisher and UACCB for their work. RE-ZONE CERTAIN PROPERTY FROM R-2 TO C-1 ON LOCATED ON 14TH STREET Councilmember Watkins introduced an ordinance to re-zone certain property located on 14th Street from R-2 to C-1. Mr. Doug Hill owns the property. Mayor Biard read the ordinance in full and Councilmember Watkins moved to suspend the rules and dispense with the second and third readings. Councilmember Cargill seconded and the roll call count was 8 for and 0 against. Councilmember Watkins moved to adopt the ordinance and Councilmember Cargill seconded. The roll call count was 8 for and 0 against. The ordinance was given 42003-11-2. Councilmember Cargill moved to adopt the emergency clause and Councilmember Carpenter seconded. All voted for. CONSIDER MANUFACTURED HOUSING ORDINANCE Councilmember Mitchum moved to remove the manufactured housing ordinance from the table for discussion and Councilmember Watkins seconded. All voted for. After a brief discussion, Councilmember Carpenter moved to adopt the ordinance. The motion failed for the lack of a second. Councilmember Watkins then introduced an ordinance to provide for the availability of affordable housing within the city of Batesville. The ordinance was the same ordinance recommended by the planning commission with a few clarifications added to section H. The Mayor read the ordinance in full. Councilmember Watkins moved to suspend the rules and dispense with the second and third readings. Councilmember Carpenter seconded and the roll call count was 8 for and 0 against. Councilmember Watkins moved to adopt the ordinance and Councilmember Carpenter seconded. The roll call count was 8 for and 0 against. The ordinance was given 42003-11-3. CONSIDER AN ORDINANCE TO AUTHORIZING FINANCING FOR HEAT AND AIR SYSTEM FOR THE MUNICIPAL BUILDING Councilmember Cargill introduced an ordinance to authorize the financing of certain equipment to be used by the City of Batesville through White River Planning and Development. The loan will be to pay for a new heating and cooling system for the Municipal Building. The Mayor read the ordinance in full and Councilmember Watkins moved to suspend the rules and dispense with the second and third readings. Councilmember Gaither seconded and the roll call count was 8 for and 0 against. Councilmember Gaither moved to adopt the ordinance and Councilmember Cargill seconded and the roll call count was 8 for and 0 against. The ordinance was given 42003-11-4. Councilmember Cargill moved to adopt the emergency clause and Councilmember Gaither seconded. All voted for. QUESTION CONCERNING PROPERTY AT BAYOU AND CHARLES STREETS At the last meeting the council discussed the condition of a house located on the southwest corner of Bayou and Charles Streets and were asked to drive by and look at the property. Code Enforcement Officer Chad McClure showed the council pictures of the property and said he had talked to the owner who said he had no plans at the present time to clean up the property. Councilmember Cargill moved to start condemnation proceedings on the property and Councilmember Terrell seconded. All voted for. FINANCIAL STATEMENT The council was given a copy of the financial statements for the month ending 10/31/03. MAYOR'S ANNOUNCEMENTS Mayor Biard said that he expected to call a special session the early part of December to present the budget and a proposed ordinance to establish an occupational licenses within the City of Batesville.
