SPECIAL MEETING
SEPTEMBER 18, 2003
The Batesville City Council met in special session on September 18, at 10:00 AM at the
Municipal Building. Mayor Joe Biard presided over the meeting. The following
councilmembers were present: Jim Cargill, R.L. Carpenter, Robert Ford, Jim Mitchum, Jerry
Pectol, Paula Terrell and Jim Watkins. Also present were the City Clerk Denise Johnston and
the City Attorney Scott Stalker. Members of the Batesville Planning Commission were also
present.
Councilmember Ford moved to approve the minutes from the last meeting.
Councilmember Gaither seconded and all voted for.
Councilmember Ford moved to approve the prepared agenda. Councilmember Pectol
seconded and all voted for.
DISCUSSION OF ACT 624, AFFORDABLE HOUSING
Mr. Jim vonTungeln, Municipal League Staff Planning Consultant, American Institute of
Certified Planners came before the council to answer questions regarding Act 624 entitled "An
act to provide for the availability of affordable housing within the municipalities of Arkansas".
Mr. vonTungeln gave the council sample regulations that he wrote to address Act 624. He said
he read the ordinance that the Planning Commission prepared and said that it was a good
ordinance but might need to be tightened up in a few areas. He said it was not imperative that
the council adopt an ordinance by October 1 as long as they were aggressively working on the
issue. He said a moratorium for 60 to 90 days would probably protect the city and give them
more time to fine-tune their ordinance. The council asked the Mayor to have a 90 day
moratorium ready to adopt at the next meeting and for Chad McClure, Code Enforcement
Officer, to make some recommended changed to the proposed ordinance for consideration.
There being no further business, Councilmember Watkins moved that the meeting be
adjourned. Councilmember Carpenter seconded and all voted for.
