DECEMBER 16, 2003
The Batesville City Council met in regular session on December 16, at 5:30 PM at the
Municipal Building. Mayor Joe Biard presided over the meeting. Councilmember Ford gave the
invocation. Upon roll call the following Councilmembers answered present: Jim Cargill, R.L.
Carpenter, Robert Ford, Gerald Gaither, Jim Mitchum, Jerry Pectol, Paula Terrell and Jim Watkins.
Also present were the City Clerk Denise Johnston and the City Attorney Scott Stalker.
Councilmember Ford moved to approve the minutes from the last meeting. Councilmember
Gaither seconded and all voted for.
Councilmember Ford moved to approve the prepared agenda as amended. Councilmember
Cargill seconded and all voted for.
SHERIFF'S REPORT
The council was given a copy of the Independence County Sheriff's Departmental Activity and
Status Report for November 2003.
CONSIDERATION OF 2004 BUDGET
The council was given a copy of the proposed budget for 2004 with the changes made as
requested. Mayor Biard read the 2004 budget ordinance in full and Councilmember Watkins moved to
dispense with the rules for the second and third readings and Councilmember Cargill seconded. The
roll call count was 8 for and 0 against. Councilmember Watkins moved to adopt the ordinance and
Councilmember Cargill seconded and the roll call count was 8 for and 0 against. The ordinance was
given 42003-12-1.
CONSIDER A RESOLUTION TO RAISE OPENING AND CLOSING FEES FOR OAKLAWN
CEMETERY
Mayor Biard read a resolution that would increase the opening and closing fees for Oaklawn
Cemetery and the Gray's Addition to Oaklawn to $350.00. Councilmember Watkins moved to adopt
the resolution and Councilmember Terrell seconded. All voted for. The resolution was given 42003-
12-3-R.
CONSIDER COMPETITIVE BIDDING FOR 2004
Mayor Biard read an ordinance that would waive competitive bidding during the calendar year
of 2004 on the purchases of used equipment, motor fuel, SB-2, Hot mix asphalt, cold mix asphalt,
property insurance and employee health insurance. Councilmember Watkins moved to dispense with
the rules for the second and third readings and Councilmember Gaither seconded. The roll call count
was 8 for and 0 against. Councilmember Cargill moved to adopt the ordinance and Councilmember
Gaither seconded. The roll call count was 8 for and 0 against. The ordinance was given 42003-12-2.
Councilmember Cargill moved to adopt the emergency clause and Councilmember Carpenter
seconded. All voted for.
CONSIDER NEW ADMINISTRATIVE FEES AND ADDITION TO EMPLOYEE
HANDBOOK
The Clerk asked the council to consider implementing administrative fees for
withholding child support, garnishments and other court mandated withholdings. The law allows up to
$2.50 per withholding per pay period. Councilmember Cargill moved to apply the state allowed
maximum fee and Councilmember Pectol seconded. All voted for.
The clerk told the council that the auditors had recommended that we have a cell phone policy
added to our personal policy. After a discussion, the council asked the clerk to prepare a cell phone
policy for adoption and also include a policy for Internet usage.
There being no further business, Councilmember Watkins moved that the meeting be
adjourned. Councilmember Carpenter seconded and all voted for.
