SPECIAL MEETING
NOVEMBER 20,2003
The Batesville City Council met in a special session on November 20, at 9:00 AM at the
Municipal Building. Mayor Joe Biard presided over the meeting. Upon roll call the following
Councilmembers answered present: Jim Cargill, R.L. Carpenter, Robert Ford, Gerald Gaither,
Jim Mitchum, Jerry Pectol, Paula Terrell and Jim Watkins. Also present were the City Clerk
Denise Johnston and the City Attorney Scott Stalker.
CONSIDER AN ORDINANCE TO AMEND ORDINANCE #935
Councilmember Pectol introduced an ordinance that would amend ordinance 4935,
Section 2, to give the Mayor authority to issue other exemptions if there is a reasonable need
which will benefit the City of Batesville to shoot fireworks inside the city limits. The council
discussed the issue and the Mayor made it clear that he would proceed with caution in a limited
manner and this exception is to be truly an exception and not the general rule. This request is
coming from Batesville High School who is in a state football playoff game on Friday,
November 21 and would like to shoot fireworks during and after the game between 6:30 and
10:30 PM. Superintendent Ted Hall said the school has hired a professional company to set off
the fireworks. Danny Russell, Assistant Fire Chief, said for safety purposes, 4 firefighters should
be present at the fireworks site. Mr. Russell said that he had one on-duty firefighter that could go
to the school but he would have to get 3 off-duty to assist firefighters. Mr. Hall said the school
would pay for the off-duty officers. Councilmember Watkins moved to suspend the rules for the
second and third readings and Councilmember Cargill seconded. The roll call count was 8 for
and 0 against. Councilmember Watkins moved to adopt the ordinance and Councilmember
Carpenter seconded. The roll call count was 8 for and 0 against. The ordinance was given
42003-11-1. Councilmember Carpenter moved to adopt the emergency clause and
Councilmember Mitchum seconded. All voted for.
There being no further business, Councilmember Mitchum moved that the meeting be
adjourned. Councilmember Watkins seconded and all voted for.
