HomeMy WebLinkAbout2003-08-12 MINUTES OF COUNCIL AUGUST 12, 2003 The Batesville City Council met in regular session on August 12, at 5:30 PM at the Municipal Building. Mayor Joe Biard presided over the meeting. Councilmember Watkins gave the invocation. Upon roll call the following Councilmembers answered present: Jim Cargill, R.L. Carpenter, Robert Ford, Gerald Gaither, Jim Mitchum, Jerry Pectol, Paula Terrell and Jim Watkins. Also present were the City Clerk Denise Johnston and the City Attorney Scott Stalker. Councilmember Ford moved to approve the minutes from the last meeting. Councilmember Cargill seconded and all voted for. Councilmember Ford moved to approve the prepared agenda as amended. Councilmember Gaither seconded and all voted for. SHERIFF'S REPORT Sheriff Keith Bowers gave the council the monthly Sheriff's report. CONSIDER A TAX BACK RESOLUTION Councilmember Watkins introduced a resolution that would endorse Pioneer Custom Molding, Inc. to participate in the Tax Back Program (as authorized by Section 15-4-2706(4) of the Consolidated Incentive Act of 2003). Mayor Biard read the resolution and Councilmember Watkins moved to adopt and Councilmember Carpenter seconded. All voted for and the resolution was given 42003-8-1-R. COX COMMUNICATIONS REPORT Mayor Biard said that the City Attorney Scott Stalker has not been able to talk to the Cox Communications attorney and would try to have a report at the next meeting. CONSIDER AN ORDINANCE TO REZONE 36.67 ACRES OF PROPERTY LOCATED IN QUAIL VALLEY FROM R-2 TO R-1. Councilmember Gaither introduced an ordinance that would rezone 36.67 acres of property located in Quail Valley from R-2 to R-1. Code Enforcement Officer Chad McClure told the council that the property is located east of Thunderbird Lane and North of South Quail Valley Drive. All of the landowners were in support of the rezoning. Mayor Biard read the ordinance and noted that a legal description is included in the ordinance. Councilmember Watkins moved to suspend the rules for the second and third readings. Councilmember Cargill seconded and the roll call count was 8 for and 0 against. Councilmember Watkins moved to adopt the ordinance and Councilmember Gaither seconded. The roll call count is 8 for and 0 against. The ordinance was given 42003-8-1. Councilmember Watkins moved to adopt the emergency clause and Councilmember Gaither seconded. All voted for. CONSIDER AN ORDINANCE AMENDING ORDINANCE #98-3-1 RELATING TO BUILDING CODES Councilmember Mitchum introduced and Mayor Biard read and ordinance that would amend ordinance 498-3-1 adopting the 2000 International Building Code and the 2000 International Residential Building Code within the city limits of Batesville. Councilmember Watkins moved to suspend the rules for the second and third readings and Councilmember Gaither seconded. The roll call count was 8 for and 0 against. Councilmember Cargill moved to adopt the ordinance and Councilmember Gaither seconded. The roll call count was 8 for and 0 against. The ordinance was given 42003- 8-2. Councilmember Gaither moved to adopt the emergency clause and Councilmember Cargill seconded. All voted for. MAYOR'S ANNOUNCEMENTS Mayor Biard told the council that Ms. Ethel Taylor purchased a cemetery space during the 1950's. In 1983, the council moved to close the ally that the space is located in therefore the space cannot be used. The Mayor asked permission to refund Ms. Taylor $350.00 for the lot. Councilmember Ford moved to refund the money and Councilmember Mitchum seconded. All voted for. NOTIFICATION OF FIXED ASSET DISPOSAL The Mayor informed the council of a fixed asset disposal. The Sanitation Department is disposing of a 1989 Dodge Dakota Pickup, Serial 418332, City Tag 4220. PAID BILLS REPORT The council was given a copy of the paid bills report for July 2003.
