SEPTEMBER 9, 2003
The Batesville City Council met in regular session on September 9, at 5:30 PM at the Municipal
Building. Mayor Joe Biard presided over the meeting. Councilmember Ford gave the invocation. Upon
roll call the following Councilmembers answered present: Jim Cargill, R.L. Carpenter, Robert Ford,
Gerald Gaither, Jim Mitchum, Jerry Pectol, Paula Terrell and Jim Watkins. Also present were the City
Clerk Denise Johnston and the City Attorney Scott Stalker.
Councilmember Ford moved to approve the minutes from the last meeting. Councilmember
Watkins seconded and all voted for.
Councilmember Ford moved to approve the prepared agenda as amended. Councilmember
Gaither seconded and all voted for.
SHERIFF'S REPORT
Sheriff Keith Bowers gave the council the monthly activity report for August.
DISCUSSION OF POSSIBLE PUBLIC FACILITIES BOARD -VAN THOMAS,WRPDD
Mr. Van Thomas addressed the council with the possibility of creating a Public Facility Board.
Mr. Thomas explained that state, county and local governments can have a Public Facility Board and that
Independence County has had one for around 15 years. Mr. Thomas said the board would be a tool for
public financing and would be made up of 5 members appointed by the Mayor and City Council. The
council said they would be interested and asked Mr. Thomas to prepare an ordinance for consideration.
UPDATE ON THE LOCKHOUSE RESTAURANT
Mayor Baird said he has spoken to Mr. Dale Cole with First Community Bank and it is his
understanding that the bank is now the "Lessee" of the property. He said that they were hopeful in
keeping the lockhouse a restaurant. The Mayor said the bank sent the city a check for the remaining
portion of the lease but there was a slight discrepancy in the amount so he returned it to the bank. The
council said they would rather receive the lease payment annually instead of one lump sum.
CONSIDER AN ORDINANCE CONCERNING MANUFACTURED HOMES - RE: ACT 624 OF
2003, THE "AFFORDABLE HOUSING"ACT.
The council was given a copy of Act 624 along with an ordinance pertaining to affordable
housing. The council looked over the ordinance and discussed it with members from the planning
commission. After a lengthy discussion, the council asked the mayor to set up a meeting with the council,
the planning commission and Mr. Jim vonTungeln with the Municipal League.
EXECUTIVE SESSION
Councilmember Watkins moved to go into executive session and Councilmember Gaither
seconded. All voted for.
Upon returning from executive session, Councilmember Terrell moved to appoint Sylvia Crosby
to the Housing Authority. Councilmember Watkins seconded. All voted for. Ms. Crosby will be fill the
unexpired term of Mr. Keller Crosby who recently passed away. The term will end 5/27/08.
MAYOR ANNOUNCEMENTS
The council was given a copy of the proposed Oaklawn Cemetery Guidelines and Restrictions.
The Mayor asked the council to look over the proposal and consider it for adoption at the next meeting.
There being no further business, Councilmember Watkins moved that the meeting be adjourned.
Councilmember Mitchum seconded and all voted for.
