JULY 22, 2003
The Batesville City Council met in regular session on July 22, at 5:30 PM at the
Municipal Building. Mayor Joe Biard presided over the meeting. Councilmember Watkins gave
the invocation. Upon roll call the following Councilmembers answered present: R.L. Carpenter,
Robert Ford, Jim Mitchum, Jerry Pectol, Paula Terrell and Jim Watkins. Councilmembers
Gaither and Cargill were absent. Also present were the City Clerk Denise Johnston and the City
Attorney Scott Stalker.
Councilmember Ford moved to approve the minutes from the last meeting.
Councilmember Watkins seconded and all voted for.
Councilmember Ford moved to approve the prepared agenda as amended.

SHERIFF'S REPORT
Captain Bill Lindsey with the Independence County Sheriff's Department gave the
council a monthly activities report.
NOISE ORDINANCE WITHOUT EMERGENCY CLAUSE
Mayor Biard read the ordinance for the third and final reading. The ordinance failed for
the lack of a motion to adopt.
CONSIDER NOISE ORDINANCE WITH EMERGENCY CLAUSE
Mayor Biard read an ordinance regulating excessive loud noises by use of sound
amplification systems from motor vehicles within the City of Batesville, declaring a penalty for
violations and declaring an emergency. Councilmember Watkins moved to suspend the rules for
the second and third reading and Councilmember Terrell seconded. The roll call count was 6 for
and 0 against. Councilmember Watkins to adopt the ordinance and Councilmember Terrell
seconded. The roll call count was 6 for and 0 against. The ordinance was given 42003-7-1.
Councilmember Watkins moved to adopt the emergency clause and Councilmember Ford. All
voted for.
CONSIDER ORDINANCE TO UPDATE FIRE CODES
Mayor Biard read an ordinance to adopt the 2002 Arkansas Fire Code. Councilmember
Ford moved to suspend the rules for the second and third reading. Councilmember Watkins
seconded and the roll call count was 6 for and 0 against. Councilmember Watkins moved to
adopt the ordinance and Councilmember Ford seconded. The roll call count was 6 for and 0
against. The ordinance was given 42003-7-2. Councilmember Mitchum moved to adopt the
emergency clause and Councilmember Watkins seconded. All voted for.
FINANCIAL REPORTS
The council was given a copy of the financial statement for June 30, 2003.
COUNCIL COMMENTS
The council discussed the condition of the house located at 5th and Vine Streets. Mr.
Carpenter said the Water Carnival is next weekend and the property needs to be cleaned up. The
council instructed the City Attorney to contact Mr. Brodie's attorney and see about getting the
property cleaned up.
The council also instructed the City Attorney to contact the attorney for Cox
Communications regarding the cable franchise and report to them at the next meeting.
There being no further business, Councilmember Mitchum moved that the meeting be
adjourned. Councilmember Terrell seconded and all voted for.
