APRIL 8, 2003
The Batesville City Council met in regular session on April 8, at 5:30 PM at the
Municipal Building. Mayor Joe Biard presided over the meeting. Councilmember Ford
gave the invocation. Upon roll call the following Councilmembers answered present:
Jim Cargill, R.L. Carpenter, Robert Ford, Gerald Gaither, Jim Mitchum, Jerry Pectol,
Paula Terrell and Jim Watkins. Also present were the City Clerk Denise Johnston and
the City Attorney Scott Stalker.
Councilmember Ford moved to approve the minutes from the last meeting.
Councilmember Pectol seconded and all voted for.
Councilmember Ford moved to approve the prepared agenda. Councilmember
Cargill seconded and all voted for.
THIRD READING FOR HOUSE NUMBER ORDINANCE
Mayor Biard read for the third and final reading an ordinance that would require
clear visible assigned numbers on residential, commercial and industrial structures within
the city limits of Batesville. After a brief discussion, Councilmember Cargill moved to
adopt the ordinance and Councilmember Watkins seconded. The roll call was 7 for and 1
(Carpenter) against. The ordinance was given 42003-4-1.
DRAFT ORDINANCE FOR LITTER CONTROL
Councilmember Gaither introduced and Mayor Biard read an ordinance that
would authorize the City to become a certified affiliate of Keep Arkansas Beautiful for
the purpose of participating in litter control programs conducted by this organization and
to qualify for provisions of Act 145 of 2001 of the Arkansas General Assembly, Arkansas
Code 8-6-404. Councilmember Cargill said he would like to take the ordinance home
and put on the second reading at the next meeting. The council agreed.
DRAFT ORDINANCE FOR NOISE CONTROL
Mayor Baird gave the council a draft ordinance that addresses excessive noise
within the city limits of Batesville. The Mayor said this was only a draft and asked the
council to take the ordinance home and bring suggestions regarding a noise ordinance to
the next meeting.
MAYOR'S ANNOUNCEMENTS
The council was given a copy of a letter from Cox Communications stating that
they respectfully decline to accept the modifications to the cable franchise.
Councilmember Cargill moved for the city attorney to reply to the letter saying the city
expects the cable company to comply with ordinance 42003-2-1 and failure to do so may
lead to litigation. Councilmember Watkins seconded and all voted for.
COUNCIL COMMENTS
Councilmember Cargill moved to send the council, city attorney, mayor and clerk
to the spring Municipal League Conference. Councilmember Pectol seconded and all
voted for.
Councilmember Terrell asked to have a quarterly report from the Animal Control
Department. Mayor Biard said he would pass the request to the Animal Control Officer.
There being no further business, Councilmember Watkins moved that the meeting
be adjourned. Councilmember Mitchum seconded and all voted for.
