HomeMy WebLinkAbout2015-05-02 ORDINANCE NO. 2015-j&-_" AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE THE CITY OF BATESVILLE TO CONTRACT FOR SLUDGE SEEDING AT THE WASTEWATER TREATMENT PLANT WHEREAS, the City of Batesville continues work on improvements to its wastewater treatment facilities pursuant to a measure approved by the voters in 2009; WHEREAS, it is necessary to be prepared to complete sludge seeding as soon as possible in order to prevent a delay for the contractors working on this phase of the project, BRB Contractors, Inc.; WHEREAS, it was impossible and impractical to bid this service, since, due to the fluid nature of construction projects, the City and contractor only recently confirmed when sludge seeding would be required; WHEREAS, it is necessary for the public health, safety, and welfare to contract for sludge seeding as soon as possible; and WHEREAS, the Batesville Water Utility refers this matter to the full Council for approval. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF BATESVILLE, ARKANSAS: Section 1. That it is necessary for the City of Batesville to contract for sludge seeding at its wastewater treatment plant. Section 2. That the a suitable contractor has been located nearby; Section 3. That Denali Water Solutions LLC has indicated it can complete the sludge seeding in the time frame required for the amount of$29,114.00 Section 4. That the City Council in accordance with the terms of Arkansas Code Annotated §14-58-303 hereby waives the requirement of competitive bidding and authorizes the Batesville Utility Department to contract with Denali Water Solutions LLC for sludge seeding at the price set forth in Section 3 above. Section 5. EMERGENCY CLAUSE: It is further found that due to the immediate need to acquire the above described goods and services, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety shall take effect from and after its passage and approval.
