• RESOLUTION FOR
ENTERPRISE ZONE PROGRAM
BATESVILLE, ARKANSAS
RESOLUTION STATING BATESVILLE'S INTEREST IN PARTICIPATION IN THE
ARKANSAS ENTERPRISE ZONE PROGRAM AND DESIGNATION OF SUCH ENTERPRISE
ZONES IN BATESVILLE/INDEPENDENCE COUNTY AND TO OTHERWISE PROVIDE WITH
RESPECT THERETO
WHEREAS, the Arkansas Enterprise Zone Act of 1983, Act 740 was
enacted by the Arkansas General Assembly, and
WHEREAS, the Arkansas Enterprise Zone Program offers significant
incentives for economic development and revitalization to some of
the most distressed areas in the city/county, and
WHEREAS, the Arkansas Industrial Development Commission (AIDC)
has designated certain Enumeration Districts and Census Block Groups
in Batesville/Independence County as eligible enterprise zones, based
on demographic and economic factors, and
WHEREAS, the City/County requests that the following Enumeration
District be designated an enterprise zone for the purpose of implementing
the Arkansas Enterprise Zone Program, and substitution of Enumeration
District 1141 for Enumeration District 1132, and
(SEE ATTACHED MAP)
WHEREAS, in accordance with the Arkansas Enterprise Zone Program
requirements the City Council and Quorum Court of Batesville/Independence
County agrees to:
1 . apply for enterprise zone designation using only approved
forms (or copies of such) ,
2. provide all requested information required pertaining to
the potential enterprise zone under consideration, to AIDC,
3. hold at least one public hearing on the application for
enterprise zone designation,
4. assume a local commitment to provide, or undertake, the
following:
a. analysis of the adequacy of police protection within
the proposed zone, and if necessary, devise and implement
a plan for improvement thereof;
b. give priority to the use, within the proposed zone, of
any employment training or community development funds
received from the state or federal government;
c. assist AIDC in certifying employers to be eligible for
the benefits of the Arkansas Enterprise Zone Program;
d. amend existing regulations to supersede any local regula-
tions or ordinances which may serve to discourage economic
development within an enterprise zone;
e. assist AIDC in evaluating progress made in an enterprise
zone within its ' jurisdiction;
f. waive any local sales or use tax imposed by the governing
body on the purchase of the material used in the construc-
tion of a building or buildings, or any addition or
improvement thereon, for housing any legitimate business
enterprise and machinery and equipment to be located
in or in connection with such building; and,
g. to keep AIDC informed whenever changes occur within the
zone, i .e. , an establishment goes out of business , is
destroyed by fire, flood, etc. , new development takes
place within the infrastructure (streets, etc. ) , changes
in local development codes that may affect the zone,
etc.
BE IT RESOLVED by the City Council in due, regular and legal
session convened this 10th day of July, 1984, that Batesville will
participate in the Arkansas Enterprise Zone Program and request
designation by the Arkansas Industrial Development Commission of the
aforementioned geographic areas as enterprise zones.
BE IT FURTHER RESOLVED that if any provision or item of this
resolution or the application thereof is held invalid, such invalidity
shall not affect other provisions, items or applications of this
resolution which can be given effect without the invalid provisions,
items or applications and to this end the provisions of this resolution
are hereby declared severable.
BE IT FURTHER RESOLVED that all resolutions or parts thereof
in conflict herewith are repealed.
