HomeMy WebLinkAbout2015-05-01 ORDINANCE NO. 2015-&-401 AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE THE CITY OF BATESVILLE TO PURCHASE A REPLACEMENT VEHICLE WHEREAS, the City of Batesville provides leaf collection services to its citizens; WHEREAS, the current truck used in leaf collection services has a history of maintenance problems and is currently out of service and in need of major repairs, which are projected to cost more than the vehicle itself is likely worth; WHEREAS, the current truck has also proven to be under-sized for its intended use, and the City should replace it with a better-equipped vehicle; WHEREAS, the current Spring months see some of the highest demand of the year for leaf collection services; WHEREAS, it is necessary for the public welfare to replace the leaf collection vehicle as soon as possible; and WHEREAS, the matter should be referred to the full Council for approval. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF BATESVILLE, ARKANSAS: Section 1. That it is necessary for the City of Batesville to purchase a replacement vehicle for use in leaf collection services. Section 2. That the City has located an appropriate replacement vehicle, a 2015 Dodge Ram 4500, at Scott Wood Chrysler; Section 3. That said vehicle has a sale price of approximately $35,000.00 more or less, and the seller will deduct $5,500.00 in the form of trade in value for the City's current truck, resulting in a purchase price of$29,500.00. Section 4. That, since competitive bidding is not feasible or practical because of the immediate need for the replacement vehicle, the City Council, in accordance with the terms of Ark. Code Ann. § 14-58-303(b)(2)(B), hereby waives the bidding requirements and authorizes the purchase of the above-described vehicle for on or about the price set forth in Section 3 above. Section 5. EMERGENCY CLAUSE: It is further found that due to the immediate need to acquire the above described goods and services, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety shall take effect from and after its passage and approval.
